        Tucked away in the information section of the HMCS site under 'Money Claim Online' seems to be further confirmation that Smithy won't look at lifting stays ''at least until the disposal of appeal''.

          Bank Charge Claims

          Following the High Court hearing on 22 May banks have been given leave to appeal.
          Pending the final outcome of this matter, the management of individual cases in the county courts is a matter for county court judges to consider based upon the circumstances of each individual case. However, at yesterday's hearing, Mr Justice Andrew Smith confirmed that the reasons behind the original stay on such proceedings continue to apply at least until the disposal of the appeal.
          If a customer decides to make a claim in a court or through Money Claims Online it will be issued in the usual way, but may then be stayed under arrangements put in place by the local judiciary.

                Justice Smith is back in chambers tomorrow and, according to his clerk, Joe McGarrity, his judgment on historicals is ''not a million miles away''. There will be a hearing for the handing down of judgdment as he expects there to be ''a lot of interest''.

                          Let's hope it's good news and the judge will rule in our favour. Although I can only hope that he lifts the waiver but I doubt it.

                            Anyone can attend righty, it is a public case, when I attended earlier in the year it was very interesting and would recommend it to anyone. Space is limited so its first come first served.
