    Sorry what I mean is now that Waiver has been lifted, for each month we dont put a claim in we are loosing money...I'm not sure if im making sense if not ill illabirate

      I wouldnt worry about that at the moment. Assuming you mean the 2001 date is kyboshed as the waivers gone we have asked for clarification on that issue. Also the 6 years can be argued under the limitations act back to 1995 if we stick with utccr.

      Main issue now is can you get ANYTHING back.

        Bloomin Hope so, I will be irritated if i can't, why isnt the gov stepping up for us, surely Mr Brown and his cabinet of illiterate friends see that stepping up for us is the right thing to do, A) Giving back money to the pubilc, THEIR public and B) Money back into the system, its not the answer to the crunch but it dam sure would help a heck of a lot!?

          I wonder if people who previously have been dead against negotiation with the banks/government/oft/fsa etc have tempered opinions following this or if people are still wanting a proper and final, FULL, and legal resolution to this case ?

            Id be willing to negotiate infact i would settle for either 75-80% back or the "£2.50" Actual cost of OD and DD setbacks! Waht do you rekon?

                  I may be missing the point here, but I cant exactly see why a) the general message being broadcast (by MSE Martin amongst others) is that it will be extremely unlikely that we will get a refund, and b) we have Lloyds looking to strike out all claims without delay.

                  The point surely is that the court decided that the OFT cannot assess the charges for fairness using the angle that they built the case around. That doesnt mean that it cant still be challenged individually does it, nor does it mean that the OFT cannot investigate under a different premise

                  That must mean that if we persist with most claims, our position hasnt in reality been weakened that much by this decision has it?

                  I for one feel that if the banks are pushed to court and compelled to reveal the costs of administering overdrafts, they wont want to do so, and I also feel that amongst other things there are areas to explore in terms of mis-selling the account in the first place and all subsequent charges levied would be on rocky ground.

                  I know that many of you know this case inside out and know far more than me, but I would interested to know what you think

                    I think the ruling means that the charges being excessive for the services provided is still on the table.

                        Im sure they can Im not sure wether students do on some accounts....BUT as they pointed out you've Agred to this when you opend your account;p,
                        I have been getting charges since i was about 16-17 for going somthing like £2 over...7years later still fighting for it!

                              What cases for under 18's, surely as an ex employer you an tell us whats the best way to ask the banker for our charges back in some cases .
                              I hate natwest Im looking for an alternative.

                                I am an ex employee not employer(I am not RBS Group HR ).
                                The reason I have said new thread is because this is nothing to do the the Supreme Court Decision and so it is irrelevant for this thread.
                                It's on the forum on the under 18 stuff anyway
