    Reactiv Media have been fined by the ICO

    This is Reactiv Media's statement

    The Reactiv board have issued a statement regarding the ICO’s decision to fine Reactiv over “nuisance calls”.

    “Whilst Reactiv Media is disappointed to receive a fine from the ICO, the fine relates almost in its entirety to events that happened 18 months ago in October & November of 2012. At that point in time there was an error in our TPS screening process, which meant we did call some numbers that we weren’t meant to call, for this we apologise. Some of these callers did however take a product or service as a result of the call. When we became aware of the error it was immediately rectified.



    At Reactiv we talk to approximately 125,000 people per week, and indeed last week the number of complaints we received from the TPS register was zero. Over the last few years as a result of taking a call from Reactiv millions of people have taken a product or service from us.



    Reactiv Media Limited takes privacy seriously and stands by a firm commitment to investigate and resolve any enquiry about the use of personal data within the time-line established via the Data Protection Act (1998).”

    An adjudication against Reactiv Media in October 2013, described concerns which had been raised by TPS registered consumers in relation to calls about PPI received from Reactiv Media, who were describing themselves as ‘a Consumer Helpline’. The Commission formally reprimanded the company and reminded it of its obligations under the Direct Marketing Code, and asked Reactive Media to review arrangements and provide a full report of actions taken to achieve compliance as a result of the investigation together with information on the handling of any future TPS complaints. This report was expected in January 2013. The Commissioners also asked that Reactiv Media meet with the DMA compliance team to ensure future compliance.

    Despite repeated reminders and further letters, Reactiv Media did not confirm that they would comply with the Commission’s sanction and the company has not submitted any report or statement of actions to secure compliance. The Commission has continued to receive complaints and had limited responses from the company. In a final letter to the company, the Commission stated that if no response was received, it would recommend to the DMA that their membership of the Association is terminated. No response was received and no appeal has been lodged. Accordingly, and in light of the serious Code breaches found and the many complaints identified the Commission have issued a recommendation to the DMA that Reactiv Media’s membership of the Association is terminated.

      News release: 28 July 2014


      The Information Commissioner’s Office has served digital marketing company Reactiv Media Limited with a £50,000 fine after an investigation discovered they had made unsolicited marketing calls to people who had registered with the Telephone Preference Service (TPS).
      The Privacy and Electronic Communications Regulations, which govern telephone marketing, prohibit making unsolicited telephone calls to people who have put their number on the TPS register. Between November 2012 and December 2013 the TPS received 481 complaints from individuals who had received unsolicited calls from Reactiv Media Limited despite registering with the TPS. The ICO also received 120 complaints.
      ICO Director of Operations, Simon Entwisle said:
      “The system is simple. People on the TPS register shouldn’t receive nuisance calls – full stop. Reactiv Media Limited ignored this rule and they must now pay a £50,000 penalty.
      “Nuisance calls and texts are a scourge for thousands of individuals and households across the UK. We will continue to target the companies responsible. To help us do this we are currently speaking with the government to get the legal bar lowered allowing us to enforce against more companies and send a stronger message.”
      Anyone can register with the Telephone Preference Service by going to their website or calling 0845 070 0707. You can register both your landline and your mobile phone. Anyone receiving unsolicited telephone call who has registered should report it to the ICO using our online survey. Over 200,000 responses have been sent in since the survey was setup early last year and the information provided is being used to help identify those companies responsible.
      The ICO has also published detailed guidance for direct marketers explaining their legal requirements under the Data Protection Act and Privacy and Electronic Communications Regulations. The guidance covers the circumstances in which organisations are able to carry out marketing over the phone, by text, by email, by post or by fax.
