  • Virgin Media - Breach of Contract

    Hello,just found this forum as an alternative to another that i won't mention.

    Just looking for,i guess clarification of something and then i will go in to,what seems to be a never ending saga for me if needed.

    I was speaking to someone in CS at virgin on Friday, regarding the same problem i've had for around 10 months and they said,not verbatim,that if virgin aren't providing at least a sufficient % of the service i am contracted to,i can leave without the early termination fee? As they would be in breach of contract.I am assuming he shouldn't have mentioned this as he works for them,whoops.

    I have tried to speak to them on the phone,to try and get some guidance on this but i am getting no where.

    I could probably use some advice on my whole account with them but i'll start here with this.


    They are making me so stressed.

    Hi and welcome to LB xx

    What is your Virgin Media contract for provision of ? TV / Broadband / Phone ?? What service/level of service have they not been providing you with. You're ten months in to what length contract ? and do you have a copy of the contract terms?

    That's probably best place to start.

    If you aren't receiving the service they have offered to you and you contracted with them to receive then it would be a breach of contract indeed.

      thanks for the quick reply,I have tv,phone and broadband with them.

      This is regarding my internet connection. I pay for 120mb,when in reality since around 4 weeks after my services became active,have been receiving between 1-30mb wirelessly. The issue has progressively gotten worse over time,to a point where i was only getting 20mb wired when i had been getting on average 100mb,and now my connection is dropping (showing the yellow warning sign on my taskbar and the status of no internet connection) but apparently on their end i am not loosing connection.

      I have had engineers out (3 i think) one which left me with no internet connection so i had to spend another hour or so on the phone getting that sorted,a new superhub,a superhub 2 and the wires re-pulled outside my front path to the main box as they had some damage but nothing is fixing the problem. I even went and got unnesserary upgrades to my laptop to prove to them that it wasn't on my end.

      Its gotten to he point where i am calling sometimes 2/3 times per day.

      I've been paying,about £35 per month for a service/speed that i can get off sky for £3.75,and i am fed up of it all. I really would prefer to avoid the hassle of leaving and going back to sky,preferably i want my connection fixed and a % of the money i have paid for this over the last 10 months but i am ready to leave if needs must.

      RE contract,when i signed up i was under the impression that i signed up for a 12month contract but i called last week and asked if there would be any fee's involved if i wished to cancel and to my shock i was told i was contracted until May 14.

        RE their terms the broadband speed is no guaranteed the contract is for the length stated in the contract you signed?

          I know the speed in only estimated but as far as i've been told by them,120mb is for wired and i should be receiving between 60-80mb wireless,and what i am receiving is unacceptable.

          I had a constant 2mb speed for a full week about a fortnight ago and no one could explain it.

          I will see if i can dig out the welcome letter i got but i am just confused about the contract term,i phoned about 4months ago asking how much it would cost to leave because i was more than p'd off and i was told x amount cancellation and that the fee was to cover the rest of my contract up until oct 13

                Always check your speed using the wired connection. The wireless connection can be degraded for many reasons.

                  yeah i do,but i was only getting 20ish mbps at one point and that was wired. they have even said the speeds i am getting aren't acceptable but i am still waiting for a reply. was told to call back tomorrow if theres been no reply to my email so we will see what happens
