    I was with Plusnet for quite a few years. Due to health problems the local housing association moved me to a new ground floor flat and I move my Plusnet account with me.

    With the introduction of the ATOS ISA my benefits was lowered to £58 while they assessed me and bedroom tax cam into force. I already have to pay towards the rent and with the extra £14 a week on top I found it hard to pay and the phone line and internet had to go.

    After talking to Plusnet they then said I had been put on a 12 month contract because I moved. I had been on a 30 day contract. This is probably correct I can't remember that part as I was in a very stressed position.

    They then sent me a bill for £92 disconnect.

    My gripe with this was they

    Sent the letter to the wrong address. Knowing they have me address as they sent me all the paperwork the week before.
    The address was just my name and the area. The post man recognised my name as its unusual and delivered it late. It was also a bank holiday. So it arrived about 11 days after being posted on a Friday. In the letter is said they had given me 14 days to reply. I just couldn't have done this due to the wrong address and bank holiday.

    I contacted them and told them I had contacted a debt advice help line and they should now give me 30 days grace to sort it out and explained that I was now on a lower rate of income and I offered them a payment of £1 a week. I was told they had to accept this offer as compared to my income it was quite fair.

    They replied saying it had already been sent to a debt collector. I then received a letter from Manchester saying they had taken over the debt and wanted £120.

    After reading the web site http://crimebodge.com/bailiff-zapper/ I sent them a letter explaining that I had received the letter wrongly addressed and they had failed to allow me to sort the debt out buy making it arrive late and refusing me the 30 days grace and also refused my offer of payment I issued a 'Baliffs Cease and Desist' notice sent recorded which they received and signed for.

    Now I'm getting harrassing calls from the debt company. I have stopped answering them now.

    Can anyone now advise me on whetre I stand and what my next action should/could be.

    I did try to make reconpence for the debt but the way they dealt with it so unfairly makes me angry.

    Hi and welcome to LB, I am Puff and disconnections is my bread and butter..

    I need to ask you a few questions about your initial disconnection.

    You say you were placed on a rolling contract with Plusnet? did they give you a name or any tariff guidelines?
    Were you disconnected due to the debt or because you asked to be?
    Which office were you put through to to speak about your problems?

      OK I signed up years ago 2010 with a 30 day rolling contract , this provided internet, phone line weekend calls. No idea if it had any name. It was just what they offered.

      I had no choice but to ask for it to be turned off as I knew I wouldn't be able to pay them. I explained my financial changes to them and they where aware of the new ESA ATOS system having affects on customers.

      I was sent a letter with a contact number on. Even though they knew I had no phone line. I went to the phone box and after 15 mins got through only to be told that the number given was the wrong one and I'd have to go on hold for another 20-30 mins to get through to the right department. I couldn't afford this on a pay phone. I then contacted them through mail and their Facebook account.

        i would suggest you asked them what the original debt is for as you are on a rolling contract, there is no term fees applicable..

          Well they say I agreed to it becoming a 12 month 'contract' when they moved it to the new address. I really can't remember but its quite possible. I was quite ill at the time and the hassle of moving and changing all the utilities over.

            ok, if you agreed to a 12 month contract, can they provide you with the time, date, and call reference to say you agreed along with how you confirmed you understood the contract was 12 months, place of birth? Mother's maiden name?

              I'm not really disputing the original debt. If I was on a contract them I might be elagable for the money. What I disagree with is their methods. The wrong address the time limit that they knew no one could keep, the breaking of the rules when contacting a debt help line and the refusal of my offer of payment. It all seems like a deliberate ploy to not bother and they handed it over to a debt collector before I could sort anything out with them.

                there is a set timescale to the credit control proceedures, and if the account isn't kept up to date or an agreement to pay i broken they kick in.

                Normally it is

                Payment date.
                +5 days letter/text message
                +14 days reminder letter
                + 17 days call restrictions
                + 21 days full block on services
                + 30 days days final demand
                + 45 days "further treatment" i.e selling the account to a DCA.

                the justification to this is you have a set time (normally 14 days) between your bill being sent and your payment to make any arrangements to pay etc.

                As for you address change, have you asked them to check notes on the account to make sure the call was dealt with correctly?

                  Should I E Mail them asking for a copy of the conversation ? I didn't refuse to pay them . I offered a payment but they said it was to late. They did it in 14 days from sending the letter to contacting the debt collectors. I didn't receive the letter until the 16th or 17th of May because they sent it to a non address. and they gave me 14 days from the 25th April.

                    I'm a plusnet employee, would you be able to provide me with a ticket ID or PN username and I'll take a look into this. We do have an automated process where an outstanding balance is sent to a debt recovery company. I'll take a look at the process followed and see if there's anything we need to/can do.
