    Start an S75 claim with your credit card company, This is a classic Dealer tactic, you finally throw your hands in the air and accept what they offer, if at all. take the advice as offered by Pezza, I can see this ending in tears otherwise, start the sooner the better.

      Yeah it's feeling like this is he route to go down. Any idea if it would cover the value of the part ex as well?

      The car was registered to my partner but I paid, would this make any difference?

        Yes, unless the dealer still has it. He would be entitled to return your old car.
        So you should claim for £5k if he has moved your old car on, or £4k plus your old car if he still has it.

          That's good to know. I've not seen it on his forecourt or websites, and I'd much rather receive the full amount. I guess the next step is to get the car back and get an independent assessment of the car, or would him withholding the vehicle and funds for this length of time be enough to make a claim rather than going down that route?

            The dealer should have refunded you within 14 days after he agreed to refund you. He was in possession of the car at the time
