Start an S75 claim with your credit card company, This is a classic Dealer tactic, you finally throw your hands in the air and accept what they offer, if at all. take the advice as offered by Pezza, I can see this ending in tears otherwise, start the sooner the better.

That's good to know. I've not seen it on his forecourt or websites, and I'd much rather receive the full amount. I guess the next step is to get the car back and get an independent assessment of the car, or would him withholding the vehicle and funds for this length of time be enough to make a claim rather than going down that route?

Hi all - some thanks, and update, and some questions!
Firstly, we managed to get a refund! The garage eventually sent us £5200 after a lot of fighting. Couldn't have done it without the advice from you guys, so thank you so much.
They refunded the money before we've taken them the log book down or signed anything over. Since they've just sent some money via bank transfer and nothing else has been formally done, I presume we still technically own the vehicle? I only ask as they've already listed it for sale. I've been in no rush to change my schedule to race down there seen as they held the car and money for three weeks. Are they breaching any rules or regulations by doing that?
In the interim we bought another motor from an excellent trader, couldn't be happier. He'd heard of this garage and had the same view as others. He advised that if we were to to register the car as SORN and told them we'd lost the logbook, we wouldn't even need to go down to the garage to hand over ownership, with the added bonus they'd have to pay a small fee to apply for a new logbook. Does this ring true? I'm not looking for ways to be petty, but they gave us a major runaround, caused a lot of stress, and put us at a loss financially, so I'm not going to sniff at a process that makes my life easier and their daily trade a little more challenging!
One last thing, is there a route to report garages that are believed to be operating in a way that mistreat customers and potentially trading knowingly dangerous vehicles?

Congratulations to you both obtaining a refund.
Your partner's name on the logbook is not proof of ownership. This is stated in the logbook
The dealer became the owner again when the contract was formed. This happened when the dealer made an offer and your partner accepted it. You could return the documents by post, saving an unwanted journey
