  • Athena Parking Charge Notice

    Sorry to have been MIA so long but work has been manic!
    I need some advice, my disabled mother parked in a disabled bay at a Lidl supermarket, the actual sign said 1 hour if you shop.
    Mum got a Civil Parking Notice for £90 for taking 58 mins in a 10min parking time?!?

    She had her disabled badges on display but they have provided photos of her car entering and leaving the car park and times. I am wondering what we can do about it.. photos to follow once I have figured out how to edit the bloody thing and upload it, no scanner so its off my phone!

    Mums doing her pictures and my letter writting ablitly is about -24 atm.

    I don't know any 10 min parking times at Lidl, unless it was a drop off / pick up point rather than a parking space ? Mind you then it wouldn't be on the ANPR in/out timer thing, that says the whole carpark would be 10 mins, which is bananas, I know I have trouble keeping up with the checkout staff at Lidl, but to park, get in, trolley it all, scan it all, pack it all and get back to the car and out the car park within 10 mins is slightly pushing it.

      no i wasnt with my mum when she went to shopping (she was being independant after having her hip replaced) and she parked as normal in the disabled bay, thanks Ame I will defs do that

        Has she got receipts/statements showing her as a regular customer ? If so contact the manager and if that fails twitter and facebook is too public for their liking. (don't let that slow down prepping an appeal until it's cancelled though as deadlines do not adjust for anything !)

          it was the first time she had ever shopped there, shes said that she will never shop there again!

          I am planning to send in a real humdinger of an appeal including photos of mums disabled badges etc, poor mum has probs walking from a disabled bay to the shop so I know she would be parked in one, she has to have the car door fully open to get out, watching her get out of my corsa is bloody hysterical!!

            I wouldn't waste time doing all that (nothing to stop you but do not identify the driver).

            Attack the shop.

            Appeal with a simple appeal probably along the lines of

            Dear Sirs,

            I, as registered keeper, wish to invoke your appeals procedure. The notice to keeper doesn't comply with Pofa 2012 schedule 4 para 9 (guessing). The driver did not exceed the time allowed either and was a genuine shopper.

            Should you reject my appeal please supply a popla code.

                Dear Sirs,

                I, as registered keeper, wish to invoke your appeals procedure. The driver was parked in a disabled bay using disabled badges, proof of which do not constitute an admission to being the driver of the vehicle, and had been shopping in the store. The signs clearly stated the alloted time was 1 hour and the vehicle was parked for, by your own admission, 58 minutes.

                In any event your charges are penal in nature and not a genuine pre estimate of loss.

                I am under no statutory obligation to name the driver and will not do so.

                If you reject my appeal please supply a popla code.

                          Need to see the signs to confirm the 1 hour but no reason not to believe. The notice to keeper is awful too so that's a slam dunk if it goes to popla.

                          What were the dates issued, event & received ? (or was it received within 14 days ?)

                            I don't get with these 10 min parking things how the anpr camera knows if you have been into the shop and made a purchase or not. Pretty sure they can't just send a ticket to everyone who stays more than 10 minutes and wait for people to send in receipts??
