  • Re: County Court claim letter over parking fines

Mystery has created the sheet for me which I planned to read off, as I'm not the greatest at explaining things :/

    Would this be okay?

It's not a memory test and should be solely about the facts and how they fit in with legal cases and the law.

Remember to politely ask if their rep has rights of audience. If the judge is switched on and runs with it good if not it won't matter.

Should you lose ask for permission to appeal, even if you don't use it it's better to have and not use than not have it and need it.

Basically, if the claimant is not present themselves, and they send a legal representative, that representative must have a right to address (speak) to the court. A law degree alone isn't enough. Essentially, if they are not subject to rules of behaviour (such as the SRA) then they are not allowed to present the case.

I'll be sure to ask. Also, I've just realised that the cases you suggested to print aren't in my evidence that I had to submit - does that matter?

How do I give the judge the cases I've printed - "as argued in UKPC v Beavis at the Supreme Court which you can view here"...?

                    Shouldn't. They are not evidence.

That'd work but i'd have them in the wallet which hopefully you'll give to the judge right at the start in which case you tell them what it is and where in the wallet they can find it.

This is way more informal than you think (normally)

Okay great - do I need to give the claimant a copy of the defence you worked on yesterday for me?

Not unless you give it to the judge.

You are using it as a script unless they decide they'd rather read it.

Plan to use it as a script. In that case I'll take it out of the wallet prepared for the claimant in case.

Their representative just spoke to me outside the court and introduced himself, and asked if I wanted I ask him anything I said no.

He then said I've read your defence and witness statement, it'll be me arguing why it's enforceable and you why it's not enforceable etc.

                              Is that normal?

yes = you stated you disagreed, he really has just stated the obvious they say you are wrong so he has to try and convince DJ he is right and you reverse stick to M1s instructions?
