    This is Burton where there are loads of errors on the equipment. Write to your local MP and tell him or her you have a court claim based on faulty equipment at the hospital. The local MP's have written to ParkingEye before (I know they have) and PE have either cancelled (because they know the equipment is faulty) or you get the £50 "pay us our costs" offer.

    Get onto PALS too and ask them to cancel. If they do not, PM me for a letter which you can send.

    So MP first, PALS second and if all else fails PM me.

      Good afternoon,


      I have spoken to ParkingEye and, due to the advanced stage that this Parking Charge is at, they have stated that a fee of £60 will be enforced in order for them to cancel this charge.

      Unfortunately, as an appeal was not submitted to ParkingEye in the first instance this is as much as I am able to do with this case.

        One more try. Back to PALS in humble mode and ask them if they can write to confirm that they have asked PE to cancel. Get that and you are home and dry. You may have sufficient already.

        Someone will come up with the case that confirms that confirms this.

          You could, politely, that the hospital are in charge and it looks as though the tail is wagging the dog.

          You could write to PE saying:

          The principal has asked you to cancel the charge and I want confirmation that this is the case and you will be doing this. In Sadler v Leigh it was agreed that when a principal told an agent to cancel, even when proceedings had started, then the agent must do so. I await your confirmation of this by return

          Or words to that effect. Hopefully someone will improve on it. It may get you a response from PE themselves showing that they have indeed have been asked to cancel but are demanding their £50 blood money.

            Ostell makes a good point about the principal cancelling. But it depends on the court and I have seen ParkingEye win even when this was the case. So it is a lottery at the SCC.

            As an alternative you could also suggest to ADR/POPLA by writing to the court today.

            I request the court under its Case Management powers to refer the case to Alternative Dispute Resolution, compliant with the 2015 new regulations. The Ombudsman Services/POPLA offer such a scheme. The case as ParkingEye points out has no novel points of law (ParkingEye V Beavis) and no complexities. The issues can be determined on the disputed facts alone.

              As previously suggested I advise that you contact ParkingEye directly to discuss this Parking Charge. This will enable ParkingEye to look into the details of your visit to establish whether an incorrect registration was inadvertently entered, or to identify whether there were any potential faults with the machine that you used.

              All contact between the Trust and ParkingEye originates from the Car Parking Office and, as such, PALS will not have contacted ParkingEye directly.

                I would like to thank you all for your help from start to finish with this matter. I wouldn't have gotten so far without your help and advice.

                I have just received an email from Burton PALS to say they are paying the £60 to get this court case dropped.

                If anyone else is in a similar boat, contact PALS and keep contacting if you have no joy at first.

                  Parking Eye sent me another reminder, even after court said no further action

                  I posted earlier this year, i managed to get the charge dropped and the court even wrote to say i didnt need to attend the hearing. i have literally just received a parking charge notice reminder from Parking Eye with all the dates on from 2015. what is their game, does anyone know?
