    i have sent no forms back regarding which court to choose, mainly because the letter started off about Mediation and whether i would like to enter into it with Parking Eye. A few days later, a letter came stating Parking Eye didnt want to Mediate. i completely forgot about the rest of the form, mainly due to the mental stress i was going through regarding my father. Thank you for asking, my father is now on the mend thankfully.

      i have just contacted PALS through their online help form, have asked them for their help in trying to cancel this charge. i will also call them on Monday

        You got the proceed letter because everything is in order for the case to go ahead. It was probably sent because you did not return the form that was asking about mediation. You have to return this to the court AND a copy to PE.

        Did you not have a copy of your defence on your computer?

        Edit: Your defence arrive as i posted.

        Did you return the form where you tell the court where you want the case to be heard? I think it's part of the form about mediation and it would be at a court that you would prefer. The court will give a date for the hearing and you will be required to submit all paperwork required 14 days before that date. Might be able to sneak in an updated defence.

        Go through the paperwork that PE sent and pick out all the bits you would argue about.
        @mystery1 Can you think of anyway now to force PE to give a full unredacted copy of their contract?

        The contract has zero significance given the defence entered.

        The defence entered is one of those that comes down to evidence and the judge on the day. If 07rachel08 is believable in court she has a great chance of winning.

          I was hoping to get additional defence and witness statement in 14 days before the hearing date. As a LIP would the judge be happy to take additional defence points ?

          Rachel: What was required in the parking. You just paid prior to exit by putting in your registration number and then just driving out?

            If they would, and they shouldn't, then they'd probably be on side enough for the defence to win.

              yes i put the registration in and the money and no ticket was issued, it is a camera system, so there is no barrier control, so you do just drive out.

              i have had a letter today, to file the Directions Questionnaire by Monday 11th January or my defence will be struck out by the court :-(

                  There is case law that supports the the principal being able to tell the agent to drop the matter even if proceedings have started. I can't remember it off the top of my head but someone will no doubt come up with it.

                  Get that directions questionnaire in the post to the court, take a copy to send to PE and phone up the court on Monday and tell them that it is on it's way. Say that you only received the letter today.

                    Thank you , will do on Monday. Please could you tell me what to expect in court, will i be alone and intimidated by someone, or is it a completely different experience. i have never been to court and the only reason i have opted to take it to court is because i dont see why i should pay a charge for something i didnt do. i have absolutely no evidence to prove myself to the court, just my account of what actually happened. is this enough?

                        OK ... seems like you've done al you can for now ( [MENTION=5354]mystery1[/MENTION] should be on later and will hopefully respond to my tag )

                        From what I've read, PE usually don't turn up to court, so it's probably going to be just you and the judge (in an 'office' type room not a 'court room') so there should be no intimidation at all!

                          The facts and some of the legal arguments are different. Some of the legal arguments, 1. you haven't used and 2. no longer apply.

                          It'll be a lawyer for them and your self and a judge in a room. No wigs and stuff.

                          Do you have a court date ? You eed to send a witness statement at least 14 days before this to explain the day and how you remember you paid etc.
