When enquiring to the court about what has happened ask if they can tell you (and send a copy) what the disclosure directions timetable is. (when evidence and witness statements need to be sent by)

So page 2 states all evidence and witness statements to be given to the opponent and the court no late than 14 days before the hearing date. Given = served (actually delivered or presumed delivered which means posting at least 2 days beforehand)

Evidence would be pictures of signs, assignment letter or the like. You might not have much but the more you have the better.

ive just had this email from the co-op - is that what you meant by knowledge of assignment?
                      Dear Mr. Morris,
Thank you for contacting the Co-operative Careline regarding Civil Enforcement.

I can confirm that Civil Enforcement Limited (CEL) did not request or obtain the consent of the Co-operative Group to an assignment to DEAL.

If I can be of any further assistance please do not hesitate to contact me again.

                      Kind regards,

                        Not really, no.

It's certainly something to disclose though because the statement that it was done with the full knowledge of the Co-op is in fact a lie.

Have you already written your witness statement and exhibits ? It would go in with those.

That's your defence not a witness statement.

                                We'll get to that soon.
