    We argued unreasonable conduct in MKDP v Ali and secured it too!!. So its always worth an application

      received a letter today from the court now saying this has been re-instated and we have a court date on the 24th april....i mean what the hell??

      how is this even possible???

        They must have applied to stop the strike out, maybe give the court a buzz and ask ?

            im going to go down and get the letter from MIL, and post what it says in a bit
            I didnt do the letter, ive got it written out in a word document, just havent printed it out and sent it in yet...to be honest we were just thankful it was all over...then this again!

                hmmm yes, usually strike out orders do say 7 days to vary order etc, that doesn't... I think you should give the court a buzz tomorrow and ask them what happened. Do you want to post the letter saying it has been reinstated?

                  and this is the letter she got today! i have noticed that it says on the back of one document that - A hearing fee of £25 is payable by the 6th February 2015 by the claimant unless you make an application for a fee concession. Failure to pay the fee will result in the hearing being removed from the list- but yet they paid the fee 19 days later?? whats the point in that little remark on the document if its not worth the paper its written on??

                    Ah sounds like possible crossed mail issue then, the court going off half cock because they were behind in their paperwork maybe.

                    Ref the 6th Feb deadline, they are usually given extra time, which may be the 17th Feb order....which probably was to pay by the 25th or so.

                      well i suppose we better move this out of completed cases and change the heading from won to still running!!

                      so i ring the court ( i tried today but it was shut, it was at 5.45 ) and what do i say?
                      do i mention the time of 1 hour and 47 minutes but yet their exhibit is clearly states 2 hours, if i mentioned that would they look at it? or even give me an answer, also whats the deal with the payment date of the 6th of feb, and them them paying on the 25th of feb anyway?

                      it feels like that big weight has been put back firmly on our shoulders again, but i feel different this time, more incensed and angry, than scared like we were last time!

                        Don't need to ring the court now so don't worry about that. Is the order from 21st Jan on the thread as you now have to comply with that ?

                                I know its only been a few days but ive completely gone off the boil with it and my head has emptied, when i get to court im unsure of the process and what will happen on the day!
