    Well the mediator said that’s what they might suggest but I’m not sure when. Strangely my postman has just arrived and I have a letter from CEL a witness statement dated 29th September!. The witness statement doesn’t say whether they are pursuing as driver or registered keeper directly. neither does it mention any of my contact attempts that must be recorded on their system.

      Would you care to post up their WS (suitably redacted).

      Suggest you start drafting your own WS as you do not want to leave it to the last moment!

            Des-8 Page 4 seems to be more about what the councils do rather than CEL. The mediator said they are pursuing as RK but im going through paperwork because i dont see it mentioned anywhere. Is that relevant?

                  It is almost impossible for anyone other than yourself to write your witness statement, as it is meant to be your account, in your own words, of what has happened.
                  It needs to be started as follows:


                  In the xxx County Court
                  Claim no xxxx
                  Between
                  XXXXXXXXXX
                  and
                  xxxxx

                  Witness Statement of xxxxx


                  I, Joe Bloggs, a plumber of no 6 any road, anywhere, being the Defendant in this case will state as follows:
                  1. I make this Witness Statement in support of my defence of this claim which is due to be heard at xxxxx Crown Court on dd/mm/yyyy
                  2. The matters set out below are within my own knowledge except where I indicate to the contrary.

                  You then put in here what occurred eg
                  3On dd.mm.yyyy one of my son's carers took him to xyz hospital
                  4 on dd mm yyyy I received a Notice to Keeper Number xxxxxxx dateddd mm yyyy from Civil Enforcement Ltd

                  ...... list everything that has happened in chronological order even eg mentioning a visit to the hospital to check on the signage
                  Number each paragraph


                  .STATEMENT OF TRUTH
                  I believe that the facts stated in this witness statement are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth

                        Hi des8 I haven't heard anything from the courts with a date and instructions for my hearing. How long does this usually take? I have a notification on MCOL saying it has been moved to my local court but can't see anything else. Will they notify by post?

                          Your local court will contact you (eventually!), sending directions about your next actions.

                          Courts are dealing with a backlog, but if you are concerned about the delay ring your local court and ask them to confirm the position

                            I cant seem to tag you but I wanted to let you know that the claim against me was struck out! I will upload the letter in case it can help others. I believe someone else on here had an issue with the same car park.

                              Brilliant!
                              As I mentioned earlier, sometimes the claimants don't even turn up for court.
                              This time they just didn't pay the final fee before the hearing..
                              For them it is a game of numbers, for their victims a time of worry.
                              Some, like yourself, just refuse to bow to their demands, but others avoid the stress and pay up!

                                des8 Hi again! It seems the courts are determined to see me, I have another claim form from the courts for a different charge from 2020! Once again I wasn't the driver and this definitely wasn't a breach of any kind. It was a wrong turning in an unfamiliar city where we ended up in a car park. We cannot have been there more than 5 minutes while we checked the google maps and then continued on our journey; we didn't even turn off the engine! I just wanted some advice on best way forward before I respond. Should I start a new thread or continue on here?
