  • Claim form from CEL ( Civil enforcement LTD)

    Hi Guys

    I am hoping you can help. I have received a claim form from Civil Enforcement Ltd for breach of contract for parking in a private care park. I am aware of the charge they are chasing but am certain it was with DBCL and I have disputed this charge for over a year with no response from the original company or the recovery company.

    I am the registered keeper of my sons motability vehicle. On 10/04/2024 his carers took him to a hospital appointment and apparently parked in the wrong car park. Costly mistake but fair enough I would have paid it, BUT I wanted it out of my name and responded swiftly to inform them I was not the driver and did this on the online form they instructed. A couple of weeks later I received a letter from DBCL chasing the fine. I tried calling and emailing the link on their website to inform them that they could not chase a debt while an appeal had been made. No response, got another letter, so I googled an email address and sent an email stating all the above and said i was still waiting for the information of me NOT being the driver to be acknowledged. Still nothing so I gave up and waited for them to contact me. CEL is not the name of the company we have had letters from so how and why have they issued a claim against us?

    I think you mean DCBL (Direct Collection Bailiffs Ltd), not DBCL.

    DCBL are debt collectors. What has most likely happened here is that CEL claim that you owe money for the parking charge and they used DCBL as debt collectors to try and collect it. But as you dispute the debt and haven't paid it DCBL will have passed it back to CEL. Only CEL, the creditor who claims you owe them money, can start a court action against you. DCBL cannot bring court claims against you in their own name because they are not the creditor.

    Is it a document from the court you have received? Or a formal 'Letter of Claim' from CEL? Either way do not ignore it. Otherwise you risk CEL going to court in your absence and getting a County Court Judgement against you by default.

      Thank you yes DCBL. I have acknowledged the claim online and ticked that I’m disputing in full. I’m just uncertain where to go from here and what information to put in my defence. They must have receipt of my emails? I was not the driver and told them that immediately but they ignored it. Quite happy to pay the original charge, my sons carers did park in wrong car park but that wasn’t clear at the time.

          Post up the documentation you have received e.g.charge notice(s) , claim form and also a photo of the signage if possible

            des8 thank you for your reply. I have been trying to upload the forms but have had trouble doing so. I have changed all the settings on my iPad and hopefully can upload now. I have numbered them in the order they were received. I don’t think I have had a letter before court action not sure if I’ve missed it or it’s called something else.

                Please can someone help me? I’m struggling to use the site and I am running out of time for my defence. I’m not sure if anyone can see my posts now. I would really appreciate some help to upload my pictures. How do I reduce my images so I can upload them

I told them I wasnt the driver but they didnt respond and sent another letter with added fees. I appealed again and told them I wasnt the driver but I got no response and then a letter arrived from DCBL. I emailed DCBL and told them that an appeal was pending and they should not be acting until the appeal was finalised but again no response. (I found the email and telephone number online) I tried ringing the number they gave to discuss my claim but no one answered. All I wanted was for them to send the ticket to the individual who was driving, it had nothing to do with me. I have acknowledged the claim online and need to submit a defence. Any advice would be welcome. Thank you in advance. I will now try to upload the pictures but they will be in 3 lots. I'm very sorry for the lack of tech savvy.

                    Try uploading to a hosting site such as IMGUR (there are others!) and posting a link here for us,

                    Did you tell CEL the name and address of the driver? Do you have proof you told them?
                    DCB Legal are solicitors acting on behalf of CEL

                      I’ve managed to reduce the photos so should be ok. I’m still at work but will upload when at home. No didn’t tell them name of driver as they didn’t give opportunity. I don’t have proof of contact as it was a link on their site to an appeal form. They must have a record of it?
