  • Gladstones Claim Form

Hello, looking for help and advice
On previous advice I have been ignoring all correspondence regarding a PCN I received over a year ago
I had displayed my parking ticket clearly but had only entered the numbers of my vehicle reg not the full reg as was required
    Appealed but was rejected.
I have now received a claim form from gladstones and have no idea what to do
I'm so tired of worrying when the next letter will come, do I just admit defeat and pay up
    Please help

    Hi & welcome to LB

Was a notice to driver (NtD....windscreen ticket) attached to the vehicle at the time?
Did you receive a postal notice to registered keeper? (NtK)
Do you still have the copies?......If so, redact personal info, leave all dates/times visible & post up pics of front & rear of notices.
Also pics of the site signs.

If you've received a county court claim form, you need to acknowledge it asap.

      Hello, thanks for the reply
Sorry for taking a while to get back to you I had some problems uploading my photo
No windscreen ticket just a PCN in the post (attached)
I don't have pictures of the site signs but I could get these but is it possible they could have changed by now?

Has the identity of the driver been revealed, simple yes or no. If no then edit your post so that the identity of the driver cannot be inferred. Use " the driver ....." etc

They have failed to comply with POFA, mainly missing 9 (2) (f) and cannot hold the keeper liable.

You still haven't answered the question about if it was a claim form

It might be a good idea to send an addendum that you are responding as being the registered keeper.
Imho, that email, as is, could be taken as being from the driver.

Do you mean you have just acknowledged?
If so, did you put any defence dialogue box?

But it was sent over a year ago, can I still amend and resend?

                            Nope......you did the right thing.
Your defence can now be submitted (filed) at a later date, that being up to 33 days from the date of issue of the claim form issue date.
We suggest leaving it until closer to that deadline......but don't miss it!

I see no reason why you can't, but alternatively you could just 'massage' the fact into your defence.
