    PRA Group need help!!

    Hi Everyone,
    My first time on here so I hope I've posted correctly.
    I have had an Mbna card for many years and for the last few years the balance had just gone up and up 😁
    I was at the point where my payments were £350 a month so I rang them up to tell them I could not afford to pay this! They allowed me to pay £67 a month which I have been doing so for the last 10 months.
    I received a letter a couple of days ago from PRA claiming they have required the debt from Mbna ( I've not been told this by Mbna but one of the letters from PRA in the same envelope was from Mbna telling me they had passed it on to PRA)
    I'm just wondering if they'd accept the same amounts or will they try and get more money from me?? The amount I owe is £13200 😩😫

    Don't worry, that is a standard threatogram where they try and say they have complied with all their duties. You do not have to fill in their Income & Expenditure form and you can ignore their meaningless reference to a 30 day hold. The account has effectively been 'on hold' for ages now. Nothing significant is going to happen after 30 days. Personally I would ignore that letter but keep an eye out for any letters referencing an escalation to court action. Come straight to us if they threaten anything further.

    Hi all,
    ive received a reply from PRA which I've hopefully uploaded. What should I do next? Also I got the letter today but it's dated Oct 19th, do the 30 days on hold apply from that date or from now?

    I suspect that they are fully aware they have nowt to back up their claim so a desperate plea for money i.e. please pay us even though we can't prove you owe anything or we'll cry!!

    Yes send the letter Belle, just add that you do not acknowledge any liability to the PRA Group at the bottom of it.

    Hi, after hearing nothing from PRA since Dec I've now received a letter offering me a discount if I pay the balance in full or I can make six monthly payments of £2000. The reason I'm in this predicament is because I couldn't afford the monthly payments so why they think I can afford what they are offering is baffling!
    Should I write to them again with the letter I was advised to write? Or do I offer them a payment I could afford each month which would be £50, not what they are hoping for but the best I could do at this time.

    I too am being harassed by PRA group and would welcome any help/expertise on the matter if possible.

    Please don't worry. They cannot do ANYTHING to enforce this debt without first going to court. That would take several months during which time we would help you defend any claim.

    Only IF they get a successful judgment could they think about a charging order (to attach debt to any owned home). You could also argue to make an arrangement to pay over time, so truly there is nothing to fear here.

    I have never ever seen bailiffs used in credit debt cases, they tend to only be used by councils to collect council tax and parking fines.

    Hi, thank you both for your replies. Yes I have heard nothing since December, no phone calls or letters! Could you please give me the worse scenario of what they can do to reclaim the credit card debt? I'm scared that they could take my house or send the bailiffs round, sorry to trouble you but I just can't relax at the moment wondering what they are up to or if they are just gonna turn up at my home.

    Hello Belle,

    As [MENTION=2]Celestine[/MENTION] says do nothing I suspect that they are aware that their " agreement " supplied is faulty and are now more likely to sell the debt off to another unsuspecting bunch.

    You do need to keep an eye on your post if anything does come up get back here asap.

    You have had no contact at all since December when you sent the letter?

    If so, then your letter has helped. It would be normal for the debt demands to continue.

    Don't do anything. You have exercised your rights as a consumer to be sent a copy of the agreement under s.78 CCA 1974, they have failed in their duties as creditor to comply. If/when they try to enforce this will be a problem for them and you would have grounds to defend. Eventually (6yrs from last payment) the account could become time barred under the Limitation Act 1980.

    Hi, it's now June and I've not heard anything back from PRA group since I last sent them a letter in Dec. What do you think is happening? I just hate having this debt hanging over my head and would like it sorting out. Should I write to them to enquire or wait until they contact me? I just don't want to be sent a court letter when I could try and offer them a payment each month.
