PRA Group need help!!

    Hi, I am paying £69 a month to barclaycard, it's been a year since I've been paying this and I've been sent a letter asking me to ring them to discuss my financial situation now. I can not afford to pay more than that right now.
    My question is should I write to them explaining this or write to them?? I spoke to them last time and they agreed to £69 and I get a statement every month which shows what I am paying off ( interest is frozen)
    Will they let me pay this amount again for another year does anyone know??
    I've had about 5 phone calls this wk so far which I haven't answered, the letter said to contact them before the 29th October so not sure if I should ring or write ( I first wrote to them when I was having difficulty and they wrote saying I had to ring them so just wondering if they'd do the same again)

    Oh right, I was gonna do it on the computer at work but that sounds complicated and wanted to get it done ASAP without any prying eyes around. I will just write it out and send it that way.

    To clarify, the CCA request letter is not a form as such, it's just a template you have to copy and paste into Word or your own text or word processing program. :nerd: If you are used to things like the the NE Derbyshire CAB online budgeting tool or similar online forms where you fill in data and then it produces a Word document for you to download and print off, I'm afraid this isn't quite as sophisticated as that.

    You will need to manually replace the bits highlighted in green with your own personal details and the details of the company.

    No, there is no time limit to send a CCA request, in this case it's mostly for your own good so you know what they've got (or not as the case may be). :thumb:

    Hi, yes I can get access to a printer but not till the wkend, but as there is no time limit as to when I have to reply back I'm happy to wait till then.
    I will let you know their reply once I've received it.

    The Consumer Credit Act does not require it to be in a certain format but these days most correspondence would be printed. Presumably you have access to a printer.

    The DCA's criteria for issuing claims doesn't always follow a clear pattern, however, one thing is for sure: they hope to obtain default judgment, and over 75% of money claims end that way. Debt purchasers buy accounts in bulk without any paperwork, so they have to go back to the original creditor to obtain it, and they may or may not be able to supply it. It's out of their control. If they see you are the sort of person who is likely to challenge them and defend a claim if one was issued, they'll probably move on to easier prey. ray:

    If they were to issue a claim, you'd have to send a CCA request anyway, and you'd always be wondering what sort of paperwork they have (if any). If you get that over with at this early stage, you would be much better prepared *if* a claim was issued in the future so as well as being your lawful right, it can only work in your favour. :thumb:

    The Debt Purchase/Debt Collection " Industry" is I think more litigious than it's ever been!
    Please try not to stress over the " possibility " of this getting as far as a hearing there's a
    fair way to go yet!

    Even if this does go forward the Small Claims Court is somewhat less formal than the higher
    courts, hearings are usually heard in " Chambers " ( the judges office) just the judge, you and
    the claimants legal representative no jury, no robes, no wigs.

    You are entitled to ask for information via the provisions of CCA 1974, it matters not what PRA may think.
    It's better to print the request, but you can handwrite if you are unable to print.

    A word of caution use a cheque or postal order for the statutory fee, endorse it " For Statutory Fee Only".
    Use signed for post check delivery date the 12 +2 Working Days starts then.
