    Re: ParkingEye Court threat

I've just found out that I can contact ParkingEye about this case on their website, they made it clear that you can pay them online, but they said nothing about appealing online :tinysmile_hmm_t2:

Is it worth me contacting them? will they still give me a POPLA number?

        Re: ParkingEye Court threat

So what if you used the internet ? It's the facts that count.

        1. In ParkingEye's reply to my defence, it says I must supply new evidence to them and the courts, is that true? I'd rather just take it to court on the day.

When your case is allocated the judge will give directions which will include all documents which each side will rely on being served to the court and opposition around 14 days prior to trial. Technically you can't ambush them although in small claims with a sympathetic judge you may just get away with a little latitude. An unsympathetic judge will crucify you. If it has not been pleaded in your defence you might not get to use the point you wish to make.

        2. Normally how much notice do you get for a court hearing?

        At least a month.

        3. Do I need to do anything now, or is it just up to ParkingEye?

Depends where you are. You haven't posted enough up for me to answer that.

        4. If this went to court, would it be easy to claim for all the time that I have wasted on this?

No. Not impossible but i suspect most people would say you'll get £90 for your day off and travel costs. I say you can get more if you can convince a judge that they were unreasonable but obviously due to the lack of detail i couldn't say yes or no to your particular case.

They will not give you a popla code once papers are issued unless the court orders it. The only basis to contact them is to negotiate a settlement. £50 seems to be as low as they'll go in the majority of cases.

I've heard nothing yet, how long will I have to wait before I know whether this is going further or not?

                              Re: ParkingEye Court threat

I've just received a "Notice of Proposed Allocation to Small Claims Track"

I'm really not good at forms, but it looks like I can agree to refer this to "Small Claims Mediation Service".

Also it mentions HMCTS free confidential Small Claims Mediation Service, which offers, prior to any hearing, free and confidential one hour telephone mediation appointments with trained HMCTS mediators.

                              It's a N180 form.

I'm assuming I should just fill in the form and return it (I think I might be able to do this online)

It's kind of getting to me, because it seems like the judgement always goes on the side of ParkingEye.

                                Yes fill it in.

I can't really comment on a case when i don't know the particular facts of it nor have i seen the defence.

Parking eye have lost plenty, especially recently.
