    I've agreed to the free mediation, but I bet ParkingEye don't agree, because they will want to drag it out, hoping I will just pay up.

    I can't see how they think they can win, when I can prove I wasn't in that car park at that time.

      The do do mediation although sometimes the questionnaire is ticked no !!

      They refused to budge on £100 in another case but that was 2 tickets so maybe it's £50 per ticket.

        Their sign in the car-park says "Failure to comply with this will result in a Parking Charge of £85" surely that means that this is a penal charge (fine)


        BTW they have said no to the mediation.

          In one case, what the judge has ruled bears out part of my arguments about the admissibility of ANPR images.

          However, it does make one wonder whether it would be simpler - and quicker - to send Parking Eye the following quote -

          causam tuam, et exsufflavi illlud: ex tuo

                    Interesting reading the code of practice:

                    APPENDIX B ENTRANCE SIGNS

                    "The sign should be placed so that it is readable by drivers without their needing to look away from the road ahead. "
                    ParkingEye has failed to do this.



                    "The capital height for Group 1 text will depend on the approach speed of traffic"
                    "Parking area entered immediately by turning off a 30 mph road, Minimum capital height for Group 1 text 60mm"

                    ParkingEye's biggest letter on their sign is just 38mm

                    This should be so easy to fight in court

                      I'm self employed, going to court will mess up my whole day, if not my whole week. What would be a fair price to ask for to cover my expense? and would I need to declare this before the court hearing?

                      Also I want to add to my defence that I didn't see the signs, how do I go about doing that?

                        You only get limited costs if you win unless you can persuade a judge that they were unreasonable.

                        The argument is not so much about whether you saw them as whether you should've seen them.

                          Well as I said above, ParkingEye haven't followed BPA's code of practice on positioning and font size of the signs as you enter the car-park.

                            David Evans of the DVLA said on BCC's Watchdog that they only release information under very strict controls and when it's lawful to do so, but they are obviously doing NOTHING to check that ParkingEye are following these strict rules, so the DVLA must be unlawfully selling our details :tinysmile_aha_t: .
