To chase you as registered keeper yes it needs to be within 14 days.

As driver there are no rules.

Best to just appeal then go via popla to get rid of it. You may have noticed many recent thread on tickets people had thought over after ignoring themonly for CEL and DEAL to resurrect them as they near statute barred.

I'm the registered keeper and the only driver of the vehicle, so unsure as to whether the 14-day limit applies or not?
Does one take precedence over the other?

Dear Sirs,

I, as registered kEeper, wish to invoke your appeals process. I was sent a letter which i received on xxxx . The driver saw no signs and in any event your charges are penal and not a genuine pre estimate of loss.

Should you reject my appeal please supply a popla code.

Yours etc


If you are lucky and they take your appeal as in time and then reject it use a popla appeal such as http://www.legalbeagles.info/forums/...-Appeal-Letter edited to suit.

If they refuse your appeal stating it's out of time then ignore or pay but do not ignore a letter before action or court papers.

This matter is for the most part unregulated so if they refuse to listen to an appeal saying it's out of time there is little else you can do.

It does technically make a difference and it's worth using if they do not know who was driving.

It is a point that could be ignored in court but technically that is incorrect but can happen. Always include it where it applies.

After some advice I received a letter from CEL for a PCN from a place I have never been to or heard of I have tried calling them to I avel i have now got another letter thearting legal action if I dont pay it please advice

Are you outside the time to appeal ?

Are the keeper and driver the same or different ?

Can you post up the letter minus personal details ?

Keeper and driver are the same I got the letter yesterday and it's dated 25th Sept 2014

You could always appeal as per M1s advice (adapting the letter to suit your circumstances tho') and if they reject, go through popla. They'll look silly if they tried to take you to court over an unpaid fine if you have never been there :lol:

So here is my issue. I received one of these notices in the post cos I am the registered keeper.

i ignored as had no idea what was on about. They added all the charges, and finally taking me to court for.

it turned out to be my wife who was using the car that day, and was 12 minutes over the 2hrs at the co-op, because she was breast feeding our 4 week daughter in the car park!

i put this in the defence statement, and case is moving to near us. Apart from including the Breastfeeding Federation, and threatening a lot of bad press for the co-op, what else should I do.

the case is against me as registered keeper. But if my wife stands as witness, to testify it was her, will they need to take out new case against her?

You can wee in a police mans hat if pregnant. Surely there are protocols here!

If this was after October 1st 2012 then they are allowed to chase you as keeper if they have met the conditions of PoFA 2012 schedule 4.

They nearly always fail to show IF you have a decent defence. Have you read Cel v Mccafferty ?
