    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.


    (6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.

    Fantastic news mine was a anpr. So to clarify I have to have received the letter within the 14 day period. As long as I don't admit to being the driver.

      Hi I've read this on another site

      its about anpr and declining to tell them who the driver was

      "If you do choose to decline you should advise the PPC just where it has failed to comply with POFA, but after the end of the period for service of the notice to keeper. If you were to advise the PPC too early then the PPC can re-serve the notice to keeper which is compliant with the Act."


      When is advising the ppc too early? ( referring to a anpr ntk)is it meaning within the first 14 days??

          Haha I have got my finger out! I've sent it this morning and included it stating that they were over the 14 day limit for notice to keeper. And this revokes the notice to myself

          and then I read the above and panicked thinking I'd said something to soon

          and also included your template.

              Hi all,


              I found this forum yesterday as a result of a "fake PCN that I received from Civil Enforcement Ltd. I did not know anything about this company before then.


              Thank you for having this forum. I hope you can guide me in my dealing with this. I received a PCN for £100, reduced to £60 if paid within 14days. I did not have my car in the car park stated in the letter, how much more staying for the 36mins stated. I thought it was a fake company until I found this forum.


              My concern is that the DVlLA released my details to this rogue company on false pretence. How did they get my car details in the first instance and what recourse do I have against the DVLA and this company.


              it is already causing me some stress and I have spent many hours thinking things over with the person in the car with me on that day to find out if we ever got into that car park by mistake. The answer is NO.


              Please can can you help?

                  Thank you Mystery 1 for your prompt response to my request.
                  i shall follow your guidance.

                  However, some friends have advised me to ignore the notice as I did not park in the said car park. What do you advise and what is the likely outcome if I follow this path?

                    If you ignore it stays alive for 6 years until it's statute barred. Recently there have been quite a few court cases for parking events in 2012.

                    What i told you is easy and final.

                        Dear Mystery1,

                        Just a point to clarify before I send the appeal off. It was stated that I parked where the signage read " Authorised vehicles only". Does this change the wordings of the appeal? Where I recollect that I parked was the forecourt of a BP station waiting for my son in my car whilst he filled his car and transacted other business in the store.
