Ax-uk are a claims management company. As it was a no-fault claim, they will have made a claim directly with the other party’s insurance company, without involving the OP’s insurance company.

Yes, interestingly on their website under Q&A, ax-uk state their customers won't have to pay the excess on their existing policy, which these days can be as much as £1k
They also provide a hire car the cost of which they claim back.
An assessment engineer inspects the vehicle, decides if its beyond economic repair or not. The customer can chose the garage for repair or take a cash alternative and keep the car
OP seems to have selected the cash alternative but somehow the car got delivered to/picked up by Copart.
Once this happened there was next to no chance of Copart returning the car

It is unclear why ax-uk contacted copart. I can only guess that the car was classified as A or B damage and could not be put back on the road. Although OP does state the damage was minor

not a cock bull story at all read what i said ax - uk are a third party ins they sorted everything out instead of my ins they did all the work with the other party's ins so its not a cock and bull story

According to post1 COPART sold the vehicle after being instructed not to do so. It is alleged that COPART said they would remove the vehicle from the auction, but did not.

If I was tony1076 I would try and find out how much the vehicle sold for at auction, and then start pursuing COPART,( who have a reputation) for the sale money.

i had a interesting email off copart yesterday they told me ax-uk only told them i wanted the car back on the day of the auction even thou i told ax weeks before i wanted the car back

According to ax-uk's website you remain the owner of the vehicle until you give up ownership. You stated you still have the full V5C.
You should write a letter of complaint to ax-uk stating you haven't given up ownership and the car should not have been auctioned by copart

no at coparts wolverhampton site to be honest I'm surprised they wrote it off it only needed a front bumper and headlight

You should ask Copart and/or ax-uk for a copy of the engineer's report
ax-uk state on their website that they are unable to change the engineer's decision

Whether or not you should initiate a court claim will depend on the value of your vehicle
How much do you think your car was worth?
Can you substantiate that valuation?

What was your vehicle: make ,model, year?


You were offered (and accepted £1420 ?),from the third parties insurer. Did you challenge this offer?
Presumably it was a book valuation.
Did you sign an acceptance note?
You were also offered a further £200 from COPART.

Just to give a bit more clarity on Copart. A lot of insurers use Copart to retrieve damaged vehicles and then take the vehicle to their yard for inspection prior to an deciding whether the vehicle is a total write off or repairable. If a write off then they use the assessors inspection and valuation to make an offer. I had a vehicle rear end my car a couple of years ago and Copart was used for this purpose. However, I would not rate them as a good company because of my experience with them. Copart was able to sell the OPs vehicle because like mine he would have had to provide the vehicle documents on pick up and once written off and an offer had been accepted, the vehicle would have legally been the insurance company's for disposal. Their payout is essentially a sale of the vehicle to the insurance company.
