    Hi all, new here. Can anyone help ?
    Nov 2014 I moved in to a tiny (probably converted garage) bedsit on back of Landladys house..Before moving in I informed the estate agent via email of my illness/disability and that I'd have visitors to help or maybe a family member from America visiting. I also informed LL after I moved in via text.

    Inventory done the landlady and I got on well..but once the visit from America came to stay- things changed.

    I had began to text landlady about heating being very low or off and water too cool to shower as it was all.on a boiler system from her house. Eventually despite me texting to say I would keep windows open -some corner damp occurred on outside wall parts in the corners- she got some guy in (no idea who he was) and stood in front of me and said family member telling him it must surely be because two people are in here (in truth the visitor came over few nights a week whilst in UK). Nothing else was said..I'd verbally reported it and the man she came in with was not for damp but a roof guy as I told I think your guttering might be blocked- water is pouring off roof (think it was fairly flat roof) .

    Anyway..from then I had letters of monthly inspections..The internet was switched off (all inclusive excpt CTAX but she neglected to tell estate agent or me that internet was limited option) the heating off or very low- with no boiler access. She began to question my visitors how long theyd be there..I went away for a few days and always let her know id be away and that my cat sitter would stop by....So she sent a letter via solicitor saying I was subletting and had moved another person in..I had a dog...and I had left my key my door and used to much heating and water and owed her for internet 30 a month! not to mention that I did no 'check out' and that I had caused severe damage and it had been impossible to inspect at any time during tenancy.

    OK- I replied...no dog..one cat..youve met her on your inspections. Key in door because I need to walk up.path to little lane where mum parks in order to get my shopping snd bring it in- with a few trips back n forth. No subletting- told you cat sitter out of couretesy via text..you knew. Visitor from usa ..is not moving another party in. Heating and water I contacted you over 12 times and eventually my mum started picking me up daily to shower as well as wash my clothes due to no washing or drying facilities.

    Damage- one carpet stain..
    Now I guess she will claim for damp damage..I informed her of it verbally, she gave no instruction so I cleaned it...I aired property and kept windows open by notifying her I would and she agreed to close them in wet weather (the property was behind a security gate by her back door) but she closed them all the time. She visited couple times a week then on one inspection bought what I thought was a trades lady with her- who went in to the bedroom and sifted thru my bedding..and personal effects..it turned out it was a neighbour..she did this infront of my family..then took photos of damp and said no more. Towards a few wks before the first 6 months was up...she asked to come in with a surveyor...bearing in mind shed already allowed some unknown to go through my things....I said I am.sorry I am too busy..and I will be moving out in a few weeks as you served a section 21 ..9 weeks after I moved in.

    I took.photos and video on day I left..by this time I had sent a letter saying id be leaving next week and get keys to her. She didnt ask or send one her many letters- for a check out..I left few weeks before 6months was up and headed out country.

    She said I was not getting my deposit and would be contacted about damages. 7months goes by...a claim letter with 3150 but no breakdown of what for..the place was tiny ! I have also photos during occupancy...texts asking if id like heating on when she was out..or sorry i was out il switch internet on..and 'thank you for keeping place looking nice' ... So shes admitted shes been in..controlled heating and net...had inspections and that i could air the place while i was out... My first time going through all this. What do I do ? ☺😕

    How much was your deposit and which of the 3 government approved schemes was it protected in?

    Did you receive the prescribed information?

        How long notice did you give and how did you give it. ( was it just one week by letter )
        how far away from the 6months was it

        is there any breakdown on the claim aty all between rent and damages claimed. really need to know exactly what the claims says, and idealy, the tenacy contract, with names and addresses redacted
        crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

          Hi 😊 it was a tiny bedsit/converted garage. £450 (exc council tax) but I'd asked for tenancy as Exc bills because CT is a bill. I was on housing after a sudden illness. She held it with Mydeposits. She served me a Section21 around 12 weeks after I moved in..for me to leave at end of 6month tenancy. No break down of costs for damages it just says: A claim against guarantor and tenant for damages arising out of the breach of the terms and conditions of an AST. The claimant claims interest under section69 of the county courts act 1984 at the rate of 8% a year from 6/5/15- 11/9/15 ( I was there on 6month contract Nov 2014-May 2015) on £3000 and also interest at the same rate up to the date of judgement or earlier payment at the daily rate of £0.66p ....

          Note- she had written to me last- in Summer 2015 saying I'd breached terms and cons, didnt do a 'check out' and my behaviour all meant she was witholding deposit and she'd further bill me for damages and any outstanding bills (recall the deal was inclusive but I had written exclusive on tenancy for council).

          I have proof in photos, video and witnesses. I can email anyone who can help ? I don't have long ☺

          Sorry, I gave notice via letter few weeks before tenancy end but she had already served to get me out at the end contract date. I was out a week or two before end and paid up to the end..and every month..24hrs in advance of the rent date.

              Please Help!! Llord claim and set aside..due Tues!!

              Hi all. Please help asap ? 😕

              Llord sent Forms for legal case for damages. I filed dispute as stacks of evidence to show place was undamaged.

              The forms turned up with my name..and my mums as gurantor- addresed to us both...on one set of forms...and one envelope addressed to us together.

              Dispute filed but Llord filed judgement back against my mum saying SHE had not responded on time.

              Believe LLord filed these forms alone because a solicitor would have sent us a form each.

              According to Katherines house northampton court...forms were sent to mine and my mums address....If that is true since we never got either of those....Why would LLord or whoever...also send one set of forms with both our names on and in one envelope addressed to us both as a singular case almost.

              Asking to be set aside..but must do right away..today..as Landlord filed for money immi...meaning a warrant could be served soon.

              Is it a defence to say the One set of forms were sent as one..in One envelope to us both ? I really believe if forms had been sent to us both..We would have each had a letter in post (with a form each) but we did not..neither of us - despite being told they'd been served....I mean who serves a joint form with both our names on the letter ?

                Guarantor Mum..Being taken to court for 4000!

                Hi all,

                As a different question. My poor mum..who signed as Guarantor is now being chased for £4000. As per my previous post we were apparantly sent 3 sets of legal forms..one yo my address..one to mums...and one to Mums in both names. Since we only received one in Both names- I filled it out as I am/was tenant and we were both listed as defendants.
                Since we only had one set of forms..we sent evidence in and I was placed in to dispute while mum was served a claim.

                At the start of the tenancy- mum paid deposit to estate agent who.only served to find an occupant. They took cash and put it in wrong DPS...Landlord had her own. I had to then bugger around trying to get the cash in to the LLs DPS called my deposits and on an inspection day...I had to sign those papers..but not my mum.

                Has a contract been broken here ? Despite that I have mountains of evidence..pics..video..texts - this woman is nuts...She visited every 4 weeks for inspection (converted garage bedsit)...wrote me 9notes in 4months..visited without asking me..bought a buddy with her on one inspection who went through my stuff..and in notes would ask me when im going away on trips and to where and shed like the address and phone number. Accused me of owning a dog and subletting..because I had a family visitor for xmas and a cat sitter for two trips away. She'd harrass me and question family as to why they were visiting and when theyd be leaving. In the end no one visited.

                She is nuts..the claim.is over damages of mould (texts proving id told her id open windows to air.. and texts to ask her to put heating on as it was controlled from her house...I had no drying or washing facilities so mould wasnt me doing wrong and in fact the advert appears to show condensation box) so now mum is facing 4grand.

                This woman had forms forwarded to 2other addresses despite having my address...Before I ever got these forms (7months after I left)

                          LL got judgement as my mum did not reply...but we only had One set of forms delivered...so we replied as one under my name. The forms had us both as defendants.

                            Hi,

                            Yes you will need to apply to set aside the Judgment against your Mother. The Claimant has submitted an application to extend the claim to the 31st March 2016 and to amend details of both defendants, so shouldn't actually have a judgment against either of you.

                            The envelope post marked WSM - was that the application notice copy ?

                              Envelope contained one set of forms AOS and Defence. The application notice turned up before that I think. How do I write witness thing or draft order ? How best do I explain that the application notice and forms are in both our names. I actually see Mum listed as first defendant....but the court seemed to have accepted it as MY reply.
