But that could be from sheer bloody mindedness, perhaps caused by Bwyan having been (allegedly) dropped on his head when a child.

No, you can trust such "people".

Re: Bryan Carter Solicitors Letter- Please help

        Good Morning

My letter from 2nd to BC still says progressing through network. Surely they must have got it. Ive not heard anything from Lowell's so far either for both claims.

This is causing me lots of stress, I'm sick with worry. I spoke to my dad and he said he would be able to payLowell's some of money if this could be resolved.

Im a carer with a disabled child and have no realistic chance of decent paid employment in the near future, so I would only be able to give a very small amount monthly even if they get a ccj.

I wish I had been able to face this before but I buried my head in the sand and hoped. it would go away.

Rang BC to confirm if they got my letter, they had.

I was very nervous but was worried. I did have to confirm my name and address and dob. Was that okay?

They said they have referred it back to Lowell's and phone later in the week for an update! Im not phoning again. The chap I spoke to was okay and pleasant on the phone but I'm still wary of them.

Thanks for all the support and help.

Well done Completely understand the telephone thing, I avoid it wherever possible too, scares the living bejesus out of me.... lol

So now just to wait for replies If you DO get a court claim don't panic, just post up here, you will be either able to defend if BC/Lowells doesn't send the documents, or enter an admission and offer to pay, backed up with your income and expenditure sheet and the court will just order an affordable monthly payment based on your circumstances. I know it is is pain going on your credit file and if we can help you avoid it we will, but as you don't own a property there isn't much they can do other than accept monthly installments.

              Thanks Amethyst

Was it okay that I had to confirm my details with BC? I just did it. Am worried they could use it against me or reset the clock. Id like to avoid two ccj's if possible.

Ill wait and see what lowells say now. Thank for all the reassurance. Everybody on the site is so helpful.

Yes it's fine, data protection stuff, it doesn't mean you have acknowledged the debt. xx Let us know if you hear anything.

Re: Bryan Carter Solicitors Letter- Please help

                    Hi,

I haven't heard a single thing from Lowell's yet. However, they are trying to trash my credit report. They have put default marker on as Oct 13 even though it actually says default date of December 2008 on the report. They are also searching my report a lot.

Does that mean it would not drop off my report now until 6 years after October when they slapped a default marker on it? it still says date of default 08 (even though i stopped paying ages before that)

Guess they wanted me to contact them very badly. I pay all my other accounts on time so will have to sort this out in the future. is that wise?

                    Thanks x

Essentially they can do what they want and it's up to you to stop them when it's wrong. I'd leave it until Durkin is heard in January as this will clarify some default issues in the supreme court.

                        They are cheeky buggers!

Im still not going to contact them about it. I can wait to clean up my credit file.

I hope the court succeeds, the debt collection companies have too much power.

                            Hi,

I have received a. letter from Co op saying they have my data ready to despatch but will only release it with a signature. I dont want to sign anything because I think some of my accounts were opened on the telephone.

Do I have to sign their letter?

Can anybody advise me on what I should do. Thank you

I might be a mere idiot but if they are asking for a signature to be able to send you the paperwork without it they wont. May I suggest you sign with your left hand if your right hand if you did not sign anything how can they check?

Im not sure if I signed anything. I cant recall from that time. Just don't want to give them my signature as Ive heard the can cut and paste it.

Would it be okay to get my sister to sign it for me? How would they know? If not I will sign it with my left hand and photocopy it before I send it. Then I will know if its been tampered with.

                                Thank you
