True,but the medical history which I will show to hospital will be for their information.I don't expect they will accept that.All what they need to do is to check my knee again by some professional Physio and compare with my origin history.That's not difficult.

Was the X ray done in the NHS hospital?(I realise one was done in Poland but am checking that). Did the Doctor in Accident and emergency look at the x ray and state his opinion as to the problem?

You have another route prior to the complaint which might be to request a copy or sight of your medical notes to see what was written in your notes. Anything in regards to diagnosis and treatment in Poland would have to be translated into English if it got that far. I think a few more questions more and I think the likelihood is that you should first of all seek to get your medical records for that specific period of time prior to any complaint to the hospital concerned.

I have to ask you this question: ultimately, what do you want to get out of this process?

Yes,the x-ray was done in NHS hospital but not at the first day in the A&E department.She didn't see my x-ray at 7.10.2011 because they made one photo few weeks latter.
I want compensation from this process.

Ok, the advice I have to start with is to get hold of your medical records to see what was recorded by the doctor as a diagnosis.

I am afraid, I will not help or provide advice in suing the NHS because as I have stated in Post 2, we are in times of austerity and with cuts in NHS funding, any money taken away from patient care could kill someone and that is something that is non negotiable for me.

However, Celestine has given advice about looking at a medical negligence solicitor if suing the NHS is what you want to do and by all means follow that advice but for purely ideological reasons stated already, I will not give advice on how to sue them.

The treatment is called the RICE method for that diagnosis:

Rest
Ice
Compression
Elevation

That is probably what they were suggesting....

Ok,I understand your concern but I think the NHS and hospital well insured just in case with similar matters.Ideological reason because of me, or is the ideological reason also to the British?

As your from Poland then you are eligible, in fact i think your polish health service would have billed the NHS for your treatment under EU regulations that allow them to do so.

So yes you certainly need to get a copy of your medical records and send in a copy of them with your letter of complaint to the NHS service in your area that runs the hospital in question describing what happened etc.

Xenophobia has nothing to do with what I am suggesting. Whether they are insured or not is irrelevant cos the money comes from somewhere and if they are insured then the premiums go up and the money comes from a place where it could have been spent on patient care(a recent article suggested £800 million which is about 1% of the claims).

Idealogical or not, my daughter is currently undertaking a medical negligence claim against her former GP because 8 years of undiagnosed kidney disease was missed (despite repeated opportunities) and she ended up losing her left kidney in surgery.

Despite having good legal knowledge myself, I wouldn't dream of conducting such a case myself. We have appointed specialist medical negligence solicitors who are taking it forward no win no fee.

They assess your claim for free, so a simple google/Law Society check for medical negligence solicitors in your area would be wise. they will be able to tell you IF you have a case or not.
