Are Appeals guaranteed to be granted, whats my chance?

    apparently all that evidence means Im very unlikely to win in retrial, am I a victim of corruption?

    the law doesn't work most of time its the thin blue line the criminals find it a laugh, but now im innocent and its convicting me , is it corruption?


    (I mean she lied in court committed purjury had to say the police had remembered wrong then went on to manipulate a judge into abusing me, thats a more serious crime than purjury, and all she has is her word of mouth over what happened, and its me that has no chance? What is going on?

    (My word of mouth will be detailed and accurate vs cross examine hers was brief and blundered)

        but i am literally innocent in teh real world but ive been convicted and it HURTS I want justice

        it was self defense she had a knife and i had severe mental health problems panic and at teh time i thought they could kill me

        then i merely pulled her hair

        thats it

        the mental health part is extremely evidenced

        the knife part is my word vs hers

        i hit many of teh exceptions for adverse inference also evidenced for mental health in a major way , i dont udnerstand how i can lose it looks liek a shut out win she only has word of mouth and she even messed that up

        i have word of mouth loads of mental health evidence from drs hospital police etc and i hit a few exceptions for adverse inference or late defense

        i just dont understand how its possible fro me to lose

        You can never reduce it to odds. Just depends who you get on the day, how the evidence comes out.

        If you are getting adverse advice from your solicitor, probably the chances aren't good.


        I mean, if you didn't give evidence, you can't really expect reasonable force to work.

        thanks for being honest what horrible system i wish it was more scientific , but im giving evidence now in the retrial and its ahrd evidence hospital visits cell cctv police witness, doesnt that swing it in my favor over the judges feeling?

        so the evidence isnt weakened so much by being late its hard evidence

        I can't immediately see the relevance of any of these things.


        Whether she's abused you or not in the past ? Whats that go to do with this incident except to create a motivation to assault her?




        And mental health issues just gives the Crown the point that you are less reliable.

        It might be unavoidable but its certainly not a point that works for you.

        ok well my panic was set off by sound its panic thats way more extreme than the common panic attack so extreme i feared for my life and safety , she was shouting setting off my panic and she had a knife, i also asked to be moved cell for teh same reason and in court i blocked my ears i couldnt even listent o my mum, this is what i mean by evidence

              Im guessing my dad knows and just let her battle on knowing it was self abuse that she couldnt handle, as an ill person

              Barry didnt care at all and doesn't know, he wasnt affected I think he was part sociopath.

              They were who the revenge was for

                My last question guys, can I appeal in a few years time if its from a magistrates court?

                It says I can on google if I have new evidence etc? What is required for a retrial in few years ?

                  I am sorry for all the problems you have had. It is not unusual for someone being interviewed by the police to stay silent or give a "no comment" interview, often on the advice of their solicitor. The issue (only from what I have seen on this site) is that you remained quiet in court. If you appeal the case is fully heard again. If you remain silent the outcome is likely to be the same. You can ask a solicitor to raise your medical issues with the CPS / Police and see if they think you are fit to stand trial. Yours is a very unusual case it seems but, without some help from professionals, will proceed as all other cases do. Once again I can only urge you to get a new solicitor and explain all the above then listen to their advice. The cost of a failed appeal is high, financially.

                      Well it is annoying! I do not believe however it would change our views of any matter. We judge everything on evidence. Nothing more, nothing less. American spellings would be irritating but would make no difference to the verdict.

                        google says u can, it goes to a high court, there are very specific reasons needed like new case changing evidence, are you guys saying google AI is wrong?

                          AI is often wrong and makes things up - including legal cases which do not exist apparently! You cannot believe it 100%. I have no idea if it is wrong in this case, only that ordinarily to appeal a conviction in the mags court at crown court there is a time limit. If you wish to appeal in a different way there may well be a route - I have no experience of this.

                            Can you explain to me where you have got the wrongheaded idea that an "adverse inference defence" is a thing and that it could help you?

                            An adverse inference is something that is usually drawn from a defendant's silence and works against them. It's not a defence or a ground for appeal so far as I know.

                            To be granted an appeal my understanding is that you would either have to produce new evidence that was not available to you at the original trial, or you need to argue that the magistrates got the law wrong at the first trial.

                            So far as I recall from your previous thread you were originally convicted because you made the fatal error of remaining silent in court and so allowed the prosecution evidence against you to go unchallenged. Your solicitor at the time warned you in writing that if you followed that course of action you would inevitably be convicted.

                            And you were inevitably convicted.

                            I don't think saying "I made a mistake by not speaking in my defence at the original trial and would like a second go" is valid grounds on which to seek an appeal

                            Just because you now want to speak up it isn't new stuff that wasn't available at the trial

                            What mistake of law do you think the magistrates made when they convicted you?

                            If you want to pursue this any further it's absolutely essential you get legal representation

                                I have the incident recorded and it shows her shouting and being nutty? Would that sway it in my favor in a retrial? Its only audio

                                Theres no way they can know the date of the audio , they cant see the actions, they dont know how I felt and they cant see the knife but it shows her shouting and being erratic angry nutty and violent sounding

                                Is that something that can change their feelings? Maybe if I used British English?
