    I can only imagine the horror of being up for murder, staying quiet because u know u havnt done anything wrong, think its already not guilty and impossible, and they put u away on a hunch and the fact that u were using dyslexic American English

    They are obviously intelligent and above the norm but it still feels like the jungle none the less, thats a real barrister, she talks like a high status enjoying - impulsive chimp, dont like that English, none of that pile of hard evidence is evidence, panic makes you less cognitive than another mentally ill person, depends on the judges mood on the day

      Did you produce this evidence at the original trial? A recording on a phone should have a date and time available. A successful appeal will need more than a recording. You will have to give your version of events and the complainant will give theirs. The mags and judge will decide who they believe and weigh up any physical evidence such as your recording. Once again, get legal advice.

      Just in the light of the above post. Staying quiet does not prove you have done nothing wrong. Nor do the magistrates think you have. You have to give your side of the story. The use of American English looks odd but has no bearing on the verdict.

        its a recording from a recording device, so no date and its long so i have to record part of it on bandicam and save that as a file

        are u seriously saying some audio is enough to win in retrial now?

        it wasnt produced at the original trial but I alluded to having it at the 1st court date (at the time i was going for you cant convict me because im innocent do what the fk I like style, because they cant do an innocent man in the modern age/world and obviously previous instructions on being quiet is mostly what i do innocent or guilty)

        id give my version of events and supply witness evidence regarding my reaction to sound

        shes already stuffed up her version of events in cross examine , she actually committed perjury, she was caught out in an embellishment lie regarding me having a knife in the hallway I did not, but they might have taken it as poor memory instead of perjury ,

        at some point she said or a court worker said she was whispering when she was shouting this obviously sounds unrealistic ie for me to attack her while she was whispering

        she then went on to pervert the course of justice and manipulated a barrister/judge into abusing me, but they might have taken this as a good ladies concern for her son

          there's a good chance my mum will get further caught out in her lies in the next court case (infact she has to as shes already committed to a very implausible and logically inconsistent account of what has happened )

          she may also drop out of going to court, if its retried , I dont know if her dropping out gives me the win?

              so are u saying despite much more hard evidence, being high detail at passing the cross examine, easily because im telling the truth, and good adverse inference defense, im going to lose vs her caught out in lies word of mouth evidence?

              How much will my current punishment likely increase by? ive got a 1000 pound fine. If its not going to change much i may as well do it anyway?

              If she drops out and she might because shes committed and is now stuck in an illogical perjury story, is that a win?

                    We have no idea what the judge plus 2 magistrates will decide. It will depend on the evidence. If you are found guilty again the punishment may remain the same, reduce or increase. That is a matter for the court.

                        No - that is for the court to decide. Your own solicitor thought you had little chance of success in the letter he sent to you. I did say "If you try again your solicitor thinks you will have limited chance of success. My advice would be to listen to your solicitor and if not happy approach another solicitor and get their views" You can of course try if you wish - it is your right to do so. But once again, get a solicitor involved.

                              Lie detector tests are not used here. I have no idea what is meant by "friends and pals" but assume you allege some form of corruption which is a ridiculous claim. I think this thread has run its course. Please see a solicitor. Take their advice. if you do appeal it would be good if you came back and told us how you get on.

                                Depends on the English used and the Judges mood on the day, and whether he wants to p his respected colleague off, and have that bad relationship/feel for months or years

                                OF COURSE YOU CANT USE A LIE DETECTOR TEST WHEN YOU ARE TELLING THE TRUTH AND HAVE BEEN FOUND GUILTY WHEN INOCENT , NATURALLY! THATS HOW A SOPHISTICATED MODERN SYSTEM WORKS!

                                Indubitably Winscone he has been sent away for a very long time indeed, I pray he asks for a retrial, I see how the Tom Foolery goes down in the court room lunch hall
