And that's just the evidence used at the disciplinary? Or was that from the investigation meeting and the disciplinary is still to come?

If the outcome of the disciplinary was based on those witness statements, then you should have enough material to put forward your own WS with your own recount of the events as you recall them. I take it you haven't yet been dismissed but are expecting dismissal?
That was from the investigatory ..... it was lots of computer based documents... 3 witness statements... none of which are dated or signed..... all full of holes in terms of dates, names and facts.

I am expecting dismissal because everythjng leading up to this and before the invedtigatory meeting indicate that.i am getting a solicitor involved tomorrow as it could mean me as a professional being hauled in front of a professional body after being dismissed and that mesns getti g the bullet and then gaving to relive it all again.

I feel i have a goid case for unfair or constructive dismissal but will take a solicitors advice on that.

I was moping around feeling sorry for myself but am now in the angry stage.

I just want to make sure i dont give too much away at the disciplibary hearing but at the aame time destroy anything they may come at me with. I want to be orepared as best as is possible.

Ah, I remember my investigation meeting many moons ago, they had reams of printouts, emails, screen prints, etc. but I only looked at them at the meeting, they didn't send them to me, however, I sent a SAR an got reams more - yet more emails, etc. but mostly rubbish.

Even when you go as far as the tribunal, they are still full of holes, and lies! :lie: Trouble is when it's just your word against theirs and there's no way to prove one way or the other.

You should make notes of all the discrepancies you find.

Is there a risk that these issues could affect your membership of that professional body?

Constructive dismissal is a form of unfair dismissal where an employee has to resign as a result of an employer's severe breach, not when you are actually dismissed. These claims have a very low success rate at the employment tribunal, just around 3%.

If your membership of a professional body is at stake, you may want to think in relation to that issue as well as the more immediate potential for dismissal. :thumb:

Yes it has potential to be damaging for yhe professional part of it too.

I am just trying to get my head right to fight the claims they are making. From one thing it has gone to several things. And it makes it harder when they only give about 24 hours to look at it all woth the jard evidence in front of me.

Best of luck for tomorrow Mr C. Just keep as calm and professional as you can under the circumstances and if you get ambushed with anything new then don't be afraid to ask for an adjournment.

Try to stand your ground and don't let them bully you into making admissions. Watch out for twisting of facts and distortion of the truth. Some questions may be designed to inadvertently trip you up so in some cases a brief and rather vague answer could be better than a detailed one.

So had the hearing and was mentioned it was adjour ed as they could not make a decision there and then. I was mentally and physically exhausted after it but i left it all in the meeting. Lets see what happens.

                        Re: Employer Disciplinary Process

As part of the process i have been made aware that another colleague has been slandering and defaming my name to other members of staff. I have filed a formal grievance against this member of staff and need some advice on the matter if possible.

Basically i am a professional and am already going through this disciplinary process - which is tough enough on its own - and what has come to light is that the person involved who is also a professional in the same trade as i am has been spreading malicious lies and gossip about my past work record at another company that we have both worked for. What she has been spreading is this.... she has been telling members of staff that I have been disciplined, in fact dismissed, from another comapny for the same things they are accusing me of at this moment. This is in fact a complete lie and i was never dismissed..... I took my former employer to court about my working conditions but before it got near a court or judge a compromise agreement was reached and I and the company signed a legally binding document which states that i was neither disciplined or dismissed.

And now this other person has been completely defaming my name to my work colleagues..... which in iteself is degrading to me but it means that i cannot really go back to work there knowing that this has happened.

Any advice would really be appreciate, especially on how to make sure my grievance is heard fully and it is actually followed through !!!

They are trying to arrange the grievance hearing for monday 26th october.

How were you 'made aware' of this? Phone call, email, face to face conversation?

I actually heard it via my sister who met up with my colleague for a social lunch who then preceeded to tell her.

This colleague was told in an open office forum with another colleague being witness to it too.

Do you know whether the 'slandering' employee was the author of one of the 3 witness statements?
