      Help please !! Months after signing my compromise agreement solicitor now evidence

      Three months after signing my compromise agreement ex employee solicitor now demanding that I provide a written statement and provide associated evidence that I have complied with the agreement ???? They have referred me to a clause buried in the agreement that states:

      "the employee shall if requested to do so by the company provide a signed statement and provide associated evidence that he has fully complied with his obligations of the agreement"

      My settlement was signed mid June 2014 and now 3 months later they come back with this ??? Are they trying to trip me up with something or trying to scare me. Why did they not request this at the time I signed the agreement.

      My solicitor has wrote to them saying he does not understand this request and this should have been requested at the time of the agreement. He thinks they are playing games and trying to cost me money by having to get solicitors to reply back to them.

      Has anybody any advice / experience of this, I would really appreciate you help.

          Your solicitor should have spotted that in my opinion. However it's there so needs dealt with.

          In reality it depends on what your obligations were. Typically it's keep your gob shut and don't steal or work/customers. Quite how you could evidence that i'm not sure. Proving a negative is always hard/impossible.

          Sending back a signed statement saying you've complied seems to be about the only answer.

          As for legal costs, i'd refer back to the agreement and see what it says. Sometimes it says your legal costs are paid and sometimes they put a limit on it. If it's the former make sure you bill them.
