    Good morning
    advice please as I’ve searched the forums but still not sure what action to take
    I received a letter from overdale solicitors/ Lowell portfolio
    basically I had loans etc around 6 years ago and couldn’t afford to repay.
    im currently living at my new address, been at this address for around 4 years and never received any letters from them before
    and have checked credit file with Experian and can’t see no CCJ’s

    heres the letter

    not sure what to do and my options going forward as did think it would be statue barred

    any help is really appreciated

    You may recall that a County Court Judgment (CCJ was entered against you on

    26-05-2021. As you have failed to maintain an agreed payment plan to clear the outstanding balance of £5813.15, our client has instructed us to apply for a Warrant of Control, unless you engage with us to reach a suitable resolution.

    What is a Warrant of Control?

    A Warrant of Control authorises a Bailiff to visit you at your home to recover the debt either by arrangement with you or by taking control of your goods to be sold at auction to settle the debt. Our application to the Court would increase the amount you owe due to the addition of court fees and the costs involved.

    What you need to do now

    You need to either make a one-off payment of £5813.15 or set up a payment plan within 14 days of the date of this letter by visiting www.overdales.com or by calling us on

    0333 111 0135. We want to assure you that wherever possible we will work with you to agree a suitable solution to your situation, but we cannot help you resolve this matter if you do not engage with us.

    You can pay your arrears securely online at www.overdales.com. When you register you can also manage your account online, use our helpful Budget Calculator and make further payments including setting up a payment plan without having to give us a call.

    If you do not pay £5813.15 in full, set up and maintain a payment plan or contact us to reach a suitable resolution to this matter within 14 days from the date of this letter, we are instructed to issue an application f

    When did you last make a payment?

      It not being on your credit file does not always mean that a CCJ has not been obtained, the best place to search is here: https://search.trustonline.org.uk/Se...saAmMmEALw_wcB

      Do they quote a case number or have they provided a copy of the judgement? If it were me I would write to them saying you do not recall any such judgement, ask them to provide a copy of the claim form and judgement. Also, ask them what address they sent the claim form to.

          good morning

          thanks for the messages really appreciate it.

          I have checked all my credit reports and it is on my transunion file

          it was registered at my old adresss.

          atticus last payment and acknowledgement was back around 2018

            so I do have a ccj the date is 21 may 2021. and i guess it was sent to my old address. but cant be sure

            obviously they have not provided me a case number or copy of the judgement as this is the first information i have received about it

            what can i do

              You can make a Set Aside Application due to the claim form being served to the wrong address.
