  • Lowell before ccj court letter

    Advice please
I have recieved the final letter before court lowell have sent me all papers I requested so I have no alternative than to pay I went on there website filled in the financial section which says I can afford to pay £7.28 lowell say it's not enough needs to be 200+ so I will still get a ccj but it won't change my financial status I also have mental health issues and disabled. Anyone any advise I'm going to ring them today but maybe someone knows what I should say

    Thank you in advance

Is this for the Vanquis or Shop Direct Acc? Shop Direct I think was £2400? if so they are aiming for payments over 12 months. If you just did the online offer section I think that's set up to say no...and so far Lowell don't have any idea of your actual circumstances, so you'll want to tell them about your health issues and financial circumstances, and how you completed their own income/expediture calculator and offered what it said was appropriate so are not sure why it was refused.

Is there anything to be gained by them obtaining a CCJ against you, it sounds like the court would order the same payments you have offered already... so do you own your own house etc that they could try and secure the debt against once they have a judgment? If not it does seem quite pointless them getting a CCJ to be awarded £10 a month when you are offering to pay that anyway.

They've sent you legible and full copy of the agreement, screenshot showing default notice was sent, default notice, notice of assignment I assume? No disputes over the account etc?
