        Sorry been a long day so I haven't had time to read back

        Have you sent a SAR to Barclaycard?

        If not I would do it now.

        Has there been a claim issued yet? If not, you can send the letters at that point such as CPR 31.14 and work on a defence etc. I will try to read back, just on the train on my way home so see how the signal hold up

            i haven’t done a sar but will get on it
            its approx 1800

            no court papers as yet. Its about a month left till statute barred. Hoping for some delaying tactics. I have been advised to send another ccs request to the solicitors although one was already sent about two years ago

                Yeah it was the right thread Under no circumstances do you even suggest to them it may be statute barred at this point because if you do you will have a claim quicker than I can down a vodka I had about some debt go SB a week or so ago ( god I hope so but there has been no post)

                  Hi Warwick. Sadly that’s ship has sailed. I should have got some advice first

                  few months ago I received a court threat from the solicitors. I assumed the the account to be statute barred so I wrote to them telling them so.

                  The reasonI assumed it was bcos of the previous cca request. They sent some statements that showed it should be statute Barred. Sorry

                    Oh dear that's a shame but something so many people do so you are not the first and not the last. Don't beat yourself up about it. If it makes you feel better , I sent some letters many moons ago that, well, I wouldn't want a Judge to see as they were far from professional -Luckily for me on that account the claim was defeated in court by great teamwork from a fantastic barrister, solicitor and not forgetting little Diana M. Lets hope they misfiled that letter under bin - it does happen more often than they would care to admit

                      I don’t think they have much info about that payment. Doesn’t appear in in statement and also when I spoke to bccard couple days ago they could only provide date and amount and not how it was paid.
                      Anyway. I will get on to what you have advised.

                          I think you need to get hold of bank statements from the time of the alleged payment not just the Barclaycard statements if you haven't already.

                          I assume you banked with Barclays as you worked for them?

                          If you still have access to the online banking for the account regardless of bank you may be able to look online, I bank with RBS and can view statements all the way back to 2011 through my online banking. It's worth looking to determine if you made a card payment or a cheque of the amount at the time.

                          If you can't view online and are still running the account as a local branch may be able to go back to check for you or at the very least order statements.

                          Failing that an SAR to the bank to obtain them.

                              If you can't get access then use a Subject Access to Information request.

                                To be honest jaguar this account has been in default since 2014... Its never been passed ob to a dca and never even recieved a letter about that debt..thry have even given me another barclays account

                                not sure whther just to let sleeping dogs lie
