I've had a letter from Nottingham saying the matter has been referred to Birmingham cc and I will be contacted in due course.

You have been served with the Claimant's Application for a Summary Judgment and their Witness Statement dated 30th May. The case has been transferred to Birmingham County court. The Application asks the court to decide the matter without a hearing (ex parte) i.e. without your involvement.

You need to deal with this situation pronto (respond to the Application) or there's a real risk that your Defence will be struck out. If you lose the SJ Application then you will probably be liable for the other side's legal costs.

I don't mean to sound negative but you did ask for advice

Hi, can anyone direct me to any information on how I reply to the application they have made for a summary judgement? will the court decide on it based on their paperwork without making any contact with me first?

Hi all, If a case is entered in to court does that put a block on it then going over 6 years and becoming statute barred?

once court papers issued the 6 year period stops, if case withdrawn the periods continue as per

I've had a look at the sample defence but as they have provided the documents I requested it doesn't seem all that relevant.

Money well spent I think. Sometimes we need to admit that however strong we believe our case is, we need help.

Even in the worst case scenario, it should help getting the best possible outcome.

Just a quick update to say this matter is still on going. Great help from Joanna Connolly and her team. As it's now subject to legal proceedings I suppose that's all I can say, a watch this space. (Fingers crossed)

The hearing has been listed for 8 January 2018 @ my local county court.
