  • **DISCONTINUED!!!** Court claim from PRA Group Ltd UK

    I've received claim form from county court business centre for a loan originally lloyds tsb now assigned to PRA Group. I've acknowledged the claim and I'm stuck how to do defence, don't recognise the loan but had credit card years ago which I was paying 5 month up until three months ago. I don't have any other correspondence connecting them to this loan. I've had no letters from Lloyds to say they have sold the debt.

      No solicitors details on claim only claimants representative name. No other address for solicitors

          The claimant claims the sum of £5034.73 for debt and interest. On 05/02 the defendant entered into an agreement with Lloyd for credit card. On 09/2010 the defendant defaulted on the agreement with outstanding balance of £4990. On 06/14 assigned to Aktiv Kapital portfolio AS, Oslo, who assigned the debt to PRA Group, notices were sent to defendant in accordance with s136 Law of Property act, payments of £125 received up to 06/16 the claimant claims the sum 4857

                You had 28 days from the date the claim was issued (once you had acknowledged the claim).

                        OK CCA request to PRA at the address on the claim form. for a copy of the agreement + £1 statutory fee, use a postal order marked " For Statutory Fee Only"
                        and send by signed for post.

                        CPR 31.14 request goes the solicitors / legal representative as shown on the claim form (no fee) this is for the documents mentioned in the particulars of the claim. i.e. The agreement, default notice and the notices of assignment. See templates in green box above.

                          Defence doesn't need to be filed until 21st Jan.
                          Send the CPR & CCA requests asap.
                          Keep copies & get proof of posting.

                              You say you've already acknowledged, so there's nothing else to send to court until your defence is due.
                              The CPR request also invites the Claimant/sols to a 28 day extension which, if they accept, you (the Defendent) will need to inform the court accordingly.
