    We are very happy to have been able to help a defender who was being sued by Cabot Financial (UK) Ltd. Not only did we get the case discontinued, but the sheriff was so unimpressed by Cabot's conduct that he awarded full costs on a solicitor/client basis together with a fee uplift!

    This is very good news for defenders in Scottish courts and shows that it really is worth having your claim assessed by a solicitor who specialises in this area of law. You may come out of it better than you went in!

      Would it be possible to give more details of the case in particular how to apply for costs. I am in the process of applying for costs against cabot financial in a case I have had struck out.

            So, an update. I applied for cost against cabot as their claim was struck out and I was successful in obtaining my costs.

            The Judge giving cabot 14 days to pay up.

            I hate to commend cabot but the cheque arrived early, before the Judges deadline.

            My case must have cost them thousands to bring to court and lose and it had no merit or chance of success.

            Cabot must have money to burn. I think in my case it would have made more commercial sense to put their money on a horse; they would have had at least some chance of a successful outcome.
