    I'd just leave it more like below, note that I've left out anything to do with an extension to file your defence as it doesn't look like it would apply in this case. Also the CPR request is separate from the s.78 CCA request. :thumb:
    1. I received the claim xxx from the Northampton County Court Business Centre on xxxxxxxxxx.
    2. Each and every allegation in the Claimants statement of case is denied unless specifically admitted in this Defence.
    3. This claim appears to be for a catalogue account regulated under the Consumer Credit Act 1974.
    4. The Claimants statement of case fails to give adequate information to enable me to properly assess my position with regards the claim. The particulars of claim fail to state when the agreement was entered into, the date of any alleged Default or any detail how the sum claimed has been calculated.
    5. The account is statutebarred by virtue of Section 5 of the Limitation Act 1980 in that in excess of 6 years have elapsed since the date on which any cause of action accrued.
    6. The Claimants statement of case states that the account was assigned from xxxxxxx date. The Defendant does not recall receiving notice of this assignment.
    7. It is denied that Shop Direct served a Default notice on the Defendant pursuant to s87 of Consumer Credit Act 1974. The Claimant is required to prove that a compliant Default Notice was served upon the Defendant.
    8. On xxxxxxxxxxxxx I sent a request for inspection of documents mentioned in the claimants statement of case under Civil Procedure Rule 31.14 to BW Legal. I requested the Claimant provide copies of the Agreement, Default Notice and Notice of Assignment.
    9. BW Legal have not not sent any of these documents to me.
    10. On the xxxx I sent a formal request for a copy of the original agreement to Lowell pursuant to s.78 of the Consumer Credit Act 1974 along with the statutory £1 fee.
    11. The Claimant has failed to comply with s.78(1) of the Consumer Credit Act 1974 and by virtue of s.78(6) of the Consumer Credit Act 1974 cannot enforce the agreement.
    12. Under Civil Procedure Rule 16.5 (4) Where the claim includes a money claim, a defendant shall be taken to require that any allegation relating to the amount of money claimed be proved unless he expressly admits the allegation. Therefore It is expected that the Claimant be required to prove the allegation that the money is owed as claimed.
    13. I request the court orders the Claimants to provide the necessary documentation in order for me to fully plead my case else the Claim should stand struck out.
    14. In the event that the relevant documents are received from the Claimants I will then be in a position to amend my defence, and would ask that the Claimants bear the costs of the amendment.
    15. It is denied that the Claimant is entitled to the relief as claimed or at all.

        I have had a written reply from bw saying client intends to continue with the claim. please find attached copy correspondence sent to court.
        what normally happens next, do I have to do anything?

          You will receive documents from the court to complete in due course, the claim will be allocated to your local court.
          These decision to continue will have been made after viewing your defence.

            hi

            when I sent requests to view the agreement or the actual sum of monies owed are lowells supposed to send this out to me?. ive checked my credit report and they have searched my credit file without my permission. also the amount they are claiming for is 90 more than on the credit file, well its around 300 more due to court costs! which is so frustrating

              If you made a request under sections 77/78/79 Of the Consumer Credit Act 1974 ( with the £1 statutory fee) Lowell must comply by sending a copy or a reconstituted copy of the agreement + a Current Statement of the account ( Not and historical statement) there is a timescale of
              12 + 2 Working Day to comply if Lowell fails to comply the debt is unenforceable until the agreement is produced.
              There are to figures " Default Sum" and the Default (ed) Balance the first is the amount of arrears that caused the default the second is the full balance owing.
              When a debt purchaser such as Lowell buys a defaulted account they inherit the " rights & obligations of the Original Creditor which includes the obligation to maintain the credit reference files in an accurate and up to date manner, which also includes searching the files.

                hi thanks for the information. I have had no information or agreement from lowells or bw legal concerning the debt but they say they are still continuing is this a normal procedure then?. I sent off both requests to Lowell and bw on the 5/8/15. so I just sit tight and wait for the court.

                  Smoke and mirrors the threat of continuing may well be followed by a begging letter offering a " discount" for settling out of court.

                  Yes sit tight, just regular checks with the court and make sure any documents from the court are promptly dealt with.

                    attached to the back of their letter is a letter with stamped copy and the same message saying client proceeding. addressed to the courts but signature is just bw legal and not a persons signature. just curious, are they always devious in how they operate?

                        I got the court forms today not quite sure what to do with them "notice of proposed allocation to the small claims track"
                        What's my defence I have had nothing from having sent requests I have to complete by 19/10 and directions questionnaire
                        no idea how to fill it out! first page says about settlement mediation and with it is an EX730 form about mediation. how can I mediate when I don't know the original amount of debt and if its SB. The original amount on Experian is 479 and LP asking for 589! then along comes LW and plops fees on top so now its 760 odd just not fair
                        any advice very greatly received.

                          OK Fishfood,

                          The Allocations questionnaire is easy.

                          Tick for small claims track, tick yes for mediation ( it's expected) this purely court procedure, the claim
                          if it goes to a hearing will be transferred to your local court.
                          The defence comes just a little later.
                          Statute Barred is a complete defence.
                          The reason for sending the "requests" for information CCA and CPR31.14 are there to get you the information
                          needed.

                          In any case all documents must be disclosed at least 14 days prior to a hearing.
                          The court fees are fixed on the small claims track when you win you don't pay them.

                          Keep calm follow what's on the forms and come back if you are still stuck.

                            just received a letter from county court. "notice of transfer of proceedings"

                            stating the small claims mediation has been unable to secure a mediation appt.
                            the claim has been transferred to the county court hearing centre for allocation.
                            it will be referred to procedural judge and they will allocate to track and give directions.

                            I have still not had the CCA request I sent

                              can anyone help please i have just had a letter from court tht its going to small claims track. judge recommended mediation ive emailed but heard nothing. they have called once before but said the other side i think were not able to make contact etc. i have to have a defence in by 29/12. i have nothing only the requests i sent for copies of agreement etc... really not sure what to write or send to courts. the hearing is in feb and the other side have to confirm to court in jan and pay fee.
                              i would be very grateful advice or how to write a defence out i feel like im out my depth with it all
