    12 + 2 days they are in default of your request and if still in default after further 30 days it became a criminal offence - but that was repealed in 2006 so isn't applicable now.

    They should supply the documents within 12 days, however there is no true sanction if they don't. The debt is just unenforceable while they are in default of the request after the 12 days ( so they can't get judgment ) but they can carry on adding interest/charges etc on the off chance they come up with the agreement at some point in the future and can go to court to enforce it.

      Strange letter arrived today from Weightmans

      A Notice of Discontinuance

      discontinues all of the claim against me .

      Does this mean its over ?

      or does it mean its over for the moment , but they can come back at a later date ?

      I do not know if its good news or bad news

      please advise

          It really is over with Cabot?. they cant come back later for the same thing ? there is no time limits for the case to brought back before the county court ?

            No they have dropped the claims,
            They cannot bring another case on the same grounds.
            Tis possible at some point the may send a Begging Letter" Dear Searcher, although we cannot enforce the debt we are sure you know that morally you should pay us etc.
            I can make some interesting suggestions as to what you should do with such a letter ( some may be physically impossible).

              It was only because the people on here found time to help me , and guide me along the way ,that things have happened the way they have , again I cant thank you enough for all your help and I promise I will not try any physically impossible manoeuvre's as it seems Cabot have done it to themselves MANY THANKS ALL WHO HELPED

                  Well as predicted the Begging has arrived ,but with a different amount on it now ,it now has court costs £400 and solicitors fees £100 added ,is this allowed to be done even though they withdrew from court action ?

                    I would report them.. it never got to court they withdrew so how can they add imaginary charges on...I guess some experienced beagle could give you advisve in what to respond or not to respond.

                      The can chase all they like (well up to the point of harrassment ) but without the CCA they can't do anything. They will have to apply to the court before starting a new claim on the same cause of action. And no they can't add the court fees and solicitors fees of a claim they chose to discontinue to the debt. They, by discontinuing, chose to write that off. Personally, I would ignore it, but if you want to respond, just state the facts - that the case was discontinued as they were unable to produce the CCA

                        For reference enclose here with a copy of a letter from xxxxxxxxxxxx,, asking me to make payment (s)
                        for an alleged debt on which Cabot failed to get judgement in the County Court.
                        Please note I do not acknowledge any debt to any company within the Cabot Group.

                        I also note that Cabot are attempting to claim the costs of its failed court action, please take note I
                        am not responsible for these cost and solicitors fees and deny all liability for these costs.

                        I am forwarding a copy of the letter to the FCA for information on the conduct of Cabot in this matter.
                        No further correspondence will be entered into on this matter.

                        Please take note I do not wish to be contacted by any of the following means:
                        Telephone Calls by Landline.
                        Telephone call via mobile phone.
                        Text messages.
                        e-mails.

                        I Cabot attempts to contact in breach of my wishes listed above I will inform the FCA about such conduct.

                          I'd lose ALL the sarcasm on the letter though, just gets backs up, and there really is no need to send it to Mr Stannard.

                          maybe soften it up a bit and sound a bit less ranty.... might go more in your favour if indeed you do cc it to the FCA or want to use it as evidence in any future proceedings .... starting point more like this.....

                          I am in receipt of your letter dated xxxxxxx in which you request I contact you to make payment on an alleged debt. I am sure you will be aware that this matter has already been the subject of court action brought by yourselves via xxxxxxxxxxxxxxxxxxx Solcitors. This action was discontinued by yourselves after a defence was filed. If you are unsure of the consequences of this I suggest you seek legal advice. I also note you appear to have added a sum for court costs and solicitors fees. I refute entirely any liability for the costs of your bringing and subsequently discontinuing court action against me.
