    mmm yes, the Strike out application was because they hadn't responded to the defence, they got stayed, then lifted the stay and send in the AQ so the reason for striking out isn't there now.

    I'd stick with just the N180 to get it to small claims first. You don't want to put a strike out application in in fast track as if they respond and there's a hearing there will be costs.

    Your directions with the N181 ask them to supply documentation, so hopefully the Judge will go your way on that, and you'll have opportunity to strike them out for non compliance with that order (in small claims so a lot less risk)

        I asked this exact question when it was lifted and the answer came as 'they simply paid the money and it was lifted with no information given' so make of that what you will?

        Claims being put on the wrong track,paperwork being dodged up,stay's being lifted with no evidence/information, coincidence it happens at the time they're outsourcing or doing whatever with their work while they've been swamped? Mines not the first i've seen that's had the stay lifted without info from MKDP in the past 4 weeks.

          Ok so I'm submitting the N181 application by email to the court in the morning, I'm trying to just tweak it and see if I've missed anything. Amethyst if you spot anything please let me know!

          Q3 ' If you answered ‘No’ to question 1, please state below the reasons why you consider it inappropriate to try to settle the claim at this stage'

          I've put the following:
          'I believe it to be inappropriate to try and settle this claim at this stage due to the claimant MKDP's failure to provide any evidence of a debt being in existence in the form of a credit agreement,default notice or assignment as requested in April 2014.'

          Is this ok?

          The only other thing is do i want to put any other info in the big information box I? or just leave it with the info that I've put above? I don't want to give them too much before it obviously gets to a hearing and i get to give them a walloping with what's in my witness statement! Then again it's saying to help the judge manage the claim and it's a fraudulent claim so im torn!

            In the Information box I would put that you believe the claim has been allocated to the wrong track as it is a simple money claim of under £2k value and as such should be allocated to the small claims track.

                    Thank you so so much Amethyst i really appreciate that, with no exaggeration it's near impossible currently given my problems but i know im in the right in all this just like everyone else whose been targeted by them,they're scam/con artists and i wont give up fighting them, i actually want one of them to dare to face me in court now!

                    I may have a little better news at the end of the week,I had to see a solicitor to alter my will last week, after telling her my story about all this she offered to have a colleague look very quickly at the case and especially at MKDP, they say they have some interesting info? Lets not get excited they're not going to help any more than the bit of digging they've done but im incredibly grateful for their help just like i am for this boards!

                    I will report back on what, if anything I find out!

                      That would be great. I have a feeling somethings going off with all the stay lifting, having no paperwork for anything. They withdrew a £14k claim couple days ago. And the ccbc mentioning civil restraint orders.... we shall see.

                          I received an automated letter more than 2 weeks ago stating it had been handed over to Leicester county court and that they would be in touch in due course with directions etc.

                          Tbh totally sick of this now, I know mkdp are pulling out/ being struck out of cases left right and centre these past few weeks but that doesn't stop those who are still being subjected to their b.s claims suffering. Im petrified each morning of the post, what court letter on behalf of these muppets might come, it literally is making me physically vomit some days from the anxiety.

                          I was advised by the solicitor that I got a few minutes of advice from, to write an honest open letter to the judge at Leicester county court, telling them about all the vexatious claims that were being made inc mine,the fact no evidence has been given,cpr requests ignored etc. Apparently they would read it and quite possibly take note. Worth a try but its having the energy to do another letter.


                          Any advice or suggestions greatly appreciated!

                            Lets hope that your court just issue some decent directions to make MKDP stump up the documents or get struck out.

                            I really don't know about the letter....we already know Northampton are pished off with MKDP, I wouldn't want to put anyone dealing with a live case in the firing line trying to get a civil restraint order or such like against MKDP.

                              So what am i to expect as the next step, something from the court telling me what to do next directions wise?

                              Nearly 3 weeks after the allocation letter now,5 months after this stupid saga started, is there anything else i can do in the meantime?

                              The solicitor i saw a few weeks ago had dealings with a few similar very dodgy 'debt' collection company's and said i should do some research so i did some digging on mkdp and the infamous Sarah Lambert.

                              Probably information you all knew but 4 of her company's were liquidated just last year(hmmm?), see here:

                              She/They also change the names of their company's ever so slightly every so often it seems eg: mk, mkd,mkrr,mke,mkdpe,mkdp and compello have done this with company's that have been liquidated:
                              Compello Card services LTD
                              Compello Finance LTD

                              Greatest one of all is MKDPE which changed to the current name of Compello holdings LTD.

                              I don't know about everyone else but no legitimate company liquidates and then reopens with one letter difference or a new word at the end, one word for all this and we all know it. FRAUD.

                              Feel free to use info anywhere you please.

                                I somewhat broke down this morning after 3 weeks of letter box watching each day until 2pm so called the court....

                                Apparently the judge in Leicester has done something,some form or order/directions/something they couldn't tell me what as its in a giant pile of paper work and they were not willing to dig it out to put me out of my misery. They said I'd know what the papers say by the end of next weekkso basically another 2 weeks waiting.

                                The best bit is I dared to ask if it goes to a hearing(we all know it most likely will) how long their wait is.......end of November/start of December!

                                So another 4 months of this possibly!

                                I know I cannot do that, I need to get this over with ASAP.
