    Hi,

    I have received a claim letter from Lowell from an old O2 debt. I read through the first steps post and need advice on what letter/s I need to send.

    The debt is a phone contract but it was a refresh contract so there were two parts that were paid separately one part for the tariff and one part for the cost of the handset. On my credit file there are two separate entries one for the handset which is specified as an unsecured loan and the monthly tariff which is specified as telecommunications Supplier. The claim in question relates to the unsecured loan part of the contract.

    My question is do I need to send a CCA request letter to the claimant because of the loan aspect or do I just send a CPR request ?

    Particulars of Claim: Please type out in full excluding names/account numbers:
    1) The Defendant entered int an agreement for a O2 Refresh account ('the Agreement') with Telefonica Uk Ltd. This Agreement provided both a service agreement for the provision of airtime, and a Consumer Credit Act 1974 regulated agreement for the provision of hardware.
    2) In breach of the Agreement, the Defendant failed to maintain the required payments and the service Agreement was terminated, with sums outstanding in respect of the provision of both airtime and hardware.
    3) The Agreement was later assigned to the Claimant on 30/04/2015 and notice given to the Defendant.
    4) Despite repeated requests for payment, the sum of £542.41 remains due and outstanding. And the claimant claims a) The said sum of £542.41 b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, but limited to one year, being £43.39 c) Costs

    Any Other Information or Background Details: I took out the phone contract in July 2013 I didn't realize until now the reason for having two entries on my credit file until googling the refresh contract. The reason payments stopped while on holiday in Egypt during August 2013 O2 decided to cut my phone off as the tariff payment direct debit got returned but the handset part got paid I have no idea why as there were funds in my account. On return to the UK I contacted O2 and explained I was abroad at the time and couldn't contact them and explained the mix up at the bank the woman on the other end was absolutely horrid said it was my problem and that I would have to pay re-connection charges, I stated that it was a genuine mistake and that it had not happened before and my account had always been in good standing since opening it in 2009. She simply replied it was tough and if I didn't pay they would get the money anyway through debt collection agency, so I just put the phone down as I couldn't be bothered to argue.

        I have no idea why no one has replied looking through the various threads posted here most are replied to quickly, my original post was Friday and nothing.

        I have no idea what to do, I've got a newborn baby and this is the last thing I needed right now with trying to care for a new baby.

        if anyone could help me I would be very grateful and it is very much appreciated.

            Well, firstly, I'm guessing you are no longer with 02 for your mobile services, sounds absolutely appallingly poor customer service.

            So after you spoke to 02 on your return from Egypt you cancelled both of your direct debits or just the tariff one?
            Kept the phone and moved to a different service provider ?

            As you'd only paid one month there would be the full credit agreement amount plus the 18 months? contract for services to pay. There will be terms on early termination in the contract.

            If you'd followed up with a complaint at the time you could have sent a copy of your bank statement to them to show the funds were available and it was their error that the payment wasn't taken etc and probably have avoided the reconnection charge ( which should also be detailed in the terms) - but I completely understand you just walking away when met with an attitude when trying to sort it out.

            You've acknowledged the claim? If not get that done with intent to defend in full.

            Send a CCA request for the handset credit agreement and a CPR request for both handset and service agreements, default notice, notice of termination, notice of assignment. CCA request goes to Lowell, and CPR request goes to Lowell Solicitors ( presumably that's who's acting for Lowell?)

              Thank you so much for replying Amethyst.

              I have acknowledged the claim via the website.

              I didn't cancel any direct debits for O2 even after they cut me off in the middle of August I made a payment via debit card in September of £34.01 this was the last payment I made. I did move to another provider but my partner sent the phone back to O2 using a returns label that we found on the O2 website for returning phones. As its nearly 5 years later I have no proof of sending it back and never received and acknowledgement from O2 saying they actually received it. As I never heard anything from O2 I just presumed (stupidly) that it was done and dusted. I can recall receiving letters relating to the tariff side of the contract but cant remember any for the handset portion of the contract thus leading me to believe it was ok.

              With the letters can they be handwritten or do they have to be typed as my printer is knackered.

                Since my last post above I sent the letters to both parties and have had a response, the first was a letter saying they have requested a copy of the agreement and that it will be sent to me upon receipt that was sent on the 29th May. Today I have had another letter saying that they have requested a copy of the agreement and default notices and that they will be sent to me upon receipt, they also enclosed a notice of assignment dated 28th may 2015 which I never received and copies of two letters dated 5th march 2018 one saying I have not repaid my O2 account and that it has been sent to the solicitors and a notice of acting. The last one is a letter of claim dated 24th march 2018 I cant recall receiving any of these .

                What are my next steps now? my defense has to be filed this Sunday and I have no idea what to put ! I'm also going on holiday for 2 weeks Sunday so any correspondence sent to me in that time I wont get until the 25th June when I get home, I don't want a CCJ issued to me while I'm away because I can't respond.

                  Send a SAR to O2 ASAP if you havent already Subject Access Request Letter

                  If you get your defence in Thurs/Fri this week then it will be a couple weeks or more before anything further would happen with the case and filing a defence protects you from any default judgment.

                  All they have sent you is letters they have sent you, nothing from O2 - so no agreement, default notice, statement of account etc. That can go in the defence, as can your actual defence about them cutting you off, your returning the phone, that you didn't cancel DD, that there was a handset agreement ( did you actually stop payments on that as it was a separate agreement it was yours to keep regardless of the airtime contract btw ), and the problems there were at the time. The technical aspects are to back up your defence and show the judge why the evidence of any debt is actually required. So have a look at the example defence and adapt it to suit - leave in the CCA element for the handset side of things.

                    Hi would be grateful if someone could give me some guidance I have been issued with a N180 form to return back to the court by 18th July how do I fill this out ?. I sent off a CCA and CPR request to lowell at the beginning of May and have got nothing back to date, jusg wondering how i proceed with filling out tbe form.

                            Hiya Amethyst no ive had nothing from Lowell only their copy of the directions questionnaire and the junk they sent me in response to my CPR and CCA request which wasn't what was asked for . Xx

                              I have received an email from the court for the mediation do I tick no to question 2 as I still have not received anything from Lowell from the CPR request or CCA letters. IF I do tick no as it's not suitable for mediation what is the next step ?
