    It's hard to say what their next move would be, but at the moment the claim is stayed so they would/could apply to lift the stay and continue with proceedings once/if they think they have enough documentation.

    However whether that documentation is good enough for them to win is another matter!

    I've raised the issue of the Claimant (Cabot Financial (UK) Ltd) being unlicensed and I note you've not pleaded that legal argument in your Defence so you still have that card up your sleeve

    Perhaps it would make sense to ask for some free legal advice from a professional so you can make an informed decision on the way forward. The claim is in your husband's name so maybe involve him in any conversation with a lawyer as well.

    No one likes going to court except lawyers.

          We let the deadline for the second offer pass which offered us a settlement of 25% of the original figure plus court costs. My husband phoned the court recently and the case remains stayed, and no application to have it lifted as yet.

          However this week we received a copy of the contract, which we asked for about six months ago.

          lso they have suggested that our defence is withdrawn before an application is made to lift the stay and we accept judgement against us for the full amount...

          hey say 'Our client is prepared to consider any reasonable settlement proposals you may wish to put forward to resolve the matter and avoid litigation...'
          We have a limited number of days to decide.

                    Whoha! Thanks to the hard work of Joanna, Di and Gerry at Joanna Connolly Solicitors, Cabot have decided to discontinue their claim against us. We are obviously over the moon and of course extremely relieved to have this nightmare behind us.

                    We would like to thank all the members of this forum who guided us through some difficult times and gave us the courage to continue.

                    We would recommend that anyone in our position seek professional advice as we have done.

                              Jo and I are pleased that this nightmare is finally over for you both. It began nine months ago when you were making payments to Restons yet they still issued a claim against your husband.

                              Your original thread title has been proved wrong. Restons didn't get a CCJ or a Charging Order on your home - and now they can't
