Re: Dave VS Cabot Financial (UK) Limited

In a panic now as they have sent me a copy of the agreement and the notice of assignment from Lloyds saying they will apply for CCJ default judgement for £50 a month if they dont get a response. I only got the docs today but they was sent last week as i was away i only just got the docs. Think i only have 3 days to make them an offer. I dont know what to do if anyone can help i will be forever grateful.

yes i entered my defense in Jan as far as im aware the claim is in stay but with them sending the copy of the agreement and notice of assignment they will apply to lift the stay. I think it is enforceable but im not sure i will try and scan the docs and post on here.

                        Did you SAR Lloyds?
Have you phoned the court to see if the stay has been lifted yet?

i did not SAR Lloyds and i have not yet contacted court i checked the mcol and nothing is updated on it since i submitted my defence. Im assuming i will get court docs as they will apply for the stay to be lifted as i only was given 14 days i am assuming this will be next week.

You say that they have sent 50-odd pages of stuff to you.
Whether that documentation is compliant or not is impossible to say without sight of same (& close scrutiny).
Whether it is accurate (or a concocted invention) would be impossible to say without sight of the original documentation or at least reference to other authentic sources.
A SAR may have revealed the truth or otherwise, either by the information contained in the SAR response.
Or sometimes, equally revealing, by information which should be in it but, for some reason, is missing.

We're flailing around in the dark atm.

You haven't SAR'd Lloyds, which may have given a clue as to whether documentation disclosed is compliant, or a clue as to the validity of a DN (if any).
You've filed a defence, but we don't know the exact wording.
Imho, as things stand, you're on the back foot.
                                & there's circa £2k on the table
