    Right, I'm a bit lost and worried here, I've overlooked and just noticed the defense due date was on 12/02/16, I sent an email to the courts on the 13th notifying of the agreement, and sent the above letter to Mortimer's on the 15th, have I missed the boat here?

          I would phone the court 03001231056, they will be able to tell you if any changes/notes etc were made on your claim

            Paul - Can you log into Moneyclaim online and see if it allows you to go through and enter a defence please.

            If it has already gone to default judgment ( which would be a bit quick) it would show up on there, or there would be a barr in place.


            If not then get a defence sorted - example http://www.legalbeagles.info/forums/...t-Court-Claims - and submit via MCOL.

            Phoning the court is a good idea, however their phone system is a bit rubbish, so loggin in on MCOL is a good way to find out if you are okay xxx

              Also - 11th Jan would mean your defence is due 13 February 2016 which was Saturday, so unless the claimant have leapt onto a default judgment on Monday you should be ok.

                Thanks for getting back to me [MENTION=6]Amethyst[/MENTION], I can't log into MCOL, and I tried really-enrolling and then importing defense, but it won't let me do that either! Problem is I need to be at work very soon, and don't have a lot of time to sort it. I didn't get the info they were supposed to send in the post, I.e password etc! Someone shoot me! Is it possible to do anything by phone? (even though they say they are having problems with their phones...)

                  Email them your defence - put your claim ref and the parties names at the top and tell them in the cover email that MCOL isn't working. In the subject put DEFENCE - CLAIM XXXXX - Cabot Financial v HubbleBubble

                      EXCELLENT....that means no default judgment as you've had nothing from the claimants it SHOULD just be quite straightforward - it's a credit card so you want the references to s.78(1) and s.78(6)

                      Just go through the example and amend to suit. If you deny ever having had the card then put that in.

                          Just for others info - I has a similar issue on Sunday I could not log in on MCOL and tried to re-register and import - it won't let you (as you said) - but what is not clear (on the MCOL website) is a MCOL a/c gets locked for 2 hours on wrong password (after 3 tries) and the 2 hrs time limit resets back every time you try even with the correct details if the initial 2hrs have not passed. - I ended locking my account by using the wrong password (thought it was the right one) - But the login page does not tell you the a/c is locked. Took a while to find this info out - Maybe this helps some one

                              Right, well here's an update on the above case, lots of people here don't seem to tell the outcome of their cases.
                              Well, crapbot and Mortimer dick have found the agreement, and every statement for this card, so it looks like I'm screwed, just filling in the form for monthly payments now. All this and my father is critically ill in hospital.
                              Having got all the statements, I've seen exactly what is spent where. Over £9600 original debt, £410 form fee, £100 costs, total over £10100, out of the original debt, £5420 is interest, late payment fees etc etc, also a useless ppi, which they (capital one) wouldn't pay out on when I needed it when my business was failing.
                              I was hoping it would have been struck out, but apparently not.
                              They also sent another letter reducing the total to £7 something K.
                              Thanks everybody for the help on here, we just weren't successful on this occasion!

                                You currently have the claim on hold in the court system - since February - it is really worth contacting the court to check the status. It could be some time before they try and pick up the case again, if ever, or it could have been discontinued already.

                                and Reclaim the PPI - you can do that direct with Capital One - http://www.capitalone.co.uk/support/ppi-complaints.jsf ( scroll down for claim form)

                                You spent what £4k ? on the card - you could always make them an offer to pay that by installment - which would save them having to reopen the case - and ask them for a consent order so as long as you pay the case just stays on hold and is discontinued once you've finished payments.

                                There are options other than just filling in the admit & offer to pay form.
