      Tick tock for me, in eight days time I will be in court contesting Cabot.......

      I have received some documentation from them but am (fairly) confident I can prove the CCA's as 'inappropriately executed'. Wish me luck :juge:

          Thanks flicky. In my case they have produced some documentation, but it is all down to knowledge of what an appropriately executed CCA should look like. They have bundled two debts together and with one of the CCA's they have sent me there is no personal reference to anyone except the original creditor (Vanquis),The 'CCA' does not even have a place for anyone to sign their name (electronically or by hand). Both accounts are very old, dating back to 2006. The other account (Aqua) they have sent a reconstructed CCA that could not have been mine as the charges stated are different to that on my very first statement which I have managed to find at home.

          Sorry, I didn't mean to sabotage your thread. Its a comfort to be in an ever increasing 'I hate Cabot' fan club :grouphug:

            Hahaha no probs hun. I hope it works out ok for you let me know. I know for a fact I didn't sign a contract as it was for a catalogue. I opened quite a few around the same time the last time they took me to court it was for a catalogue but like I said produced nothing this time is for the same catalogue jd Williams group so I'm hoping it goes the same way. Fingers crossed anyway

              I had a catalogue account many years ago (Grattan) and thankfully I kept their last letter stating that because they did not have a CCA for me they will not pursue the account. The account is also statute barred now. I think in times gone by it was extremely easy to open catalogue accounts with very little paperwork and checks done. Their APR's were always much higher than that of credit cards or other lending.

              Cabot are really scraping the bottom of barrels with these accounts. They will most certainly know that they do not have a leg to stand on in court but try to intimidate folk with court proceedings hoping that people are ignorant.

                I totally agree with u. I did this many years ago 5/6 years ago I think sent off cca requests I think I had about 8/9 catalogues.yes I was very young and stupid but even back then they couldn't produce anything and alot of them like u said they wouldn't pursue it anymore and would close the account but unfortunately I didn't keep the letters. But like u said I think they r just trying their luck. If I hadn't of found this fantastic site I would have just signed the court papers and let Cabot carry on but with the help of this site I'm gonna kick ass right back at them lol. But I know some people would just pay up cos they don't know any different

                  I'm in court next Friday, I will report back on how I get on. Amethyst has mentioned in recent times that hopefully new legislation will be coming out this April that will mean that companies such as Cabot will have to make sure they have the correct supporting paperwork before issuing court proceedings. I believe Cabot are trying to push through as many cases on their books as possible before this legislation comes into force.

                        Hi guys still no news from Cabot. It's been 9 working days since they received my cca how much longer do I give them?. Also wondered if someone would b able to help write my defence please x

                          Cabot will most likely reply and say they will take 40 days to find the CCA. You stick to the court deadlines so ensure your defence is in before you defence deadline. Once you have done a draft post it opn here and we'll help you from there.

                              hi guys hope you are all ok? received a letter from cabot today I,m guessing its their standard letter basically saying thank you for ur cca request but they don't have it and are asking the original lender for it. ( there isn't one so they will b waiting a long time). also they will provide this info within 40 days. but they will let me know if they cannot do this within those time limits.


                              so what do I do now??? any advice would b a help.
