    Hi guys I have received a claim from Cabot finance regarding a catalogue I had years ago. The particulars of claim state April 2007 I have not made a payment or anything on this account for over 6 years. I have sent off the acknowledgement of service form today and will b sending off the cca request to Cabot and and another to Reston solicitors who are also named on the claim. The date of issue is 22/12/14 can u please tell me when my 28 days ends. Also is there anything else I need to do at the mo. Thanks in advance for you help.

    If you are sure that you have not acknowledged or made a payment for over six years then it is statute barred! Cabot really make my blood boil!!!!

    It is long overdue these idiots get their backsides kicked for wasting court time!!

      thanks ruby I haven't acknowledged or made a payment in over 6 years. this is the 2 cabot claim ive had in 5 months, the last one didn't come to anything as they couldn't provide anything and I sent my defence with help from the guys on here but still nothing. that was September so im hoping this will b the same. is the 28 days from the date I receive the claim oe date its issued and is it working days sorry I cant remember :santa_cheesy:

            ive worked out that my 28 days is the 17th jan that's from 24th dec is that right?? is that when I need my defence in toomasred:

              I get Saturday, January 24, 2015, from issue - The date of issue is 22/12/14 - but I've added in the five days for service allowed If you aim for the 17th as your defence date you will be fine then if you are a couple days late.

              Yes that's when you need to have your defence in by.

              (within 14 days of receiving the claim)

              1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
              You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

              2: Send A CCA REQUEST to the CLAIMANT ( see here )
              This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


              3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

              This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)

                  Hi amethyst Thank you for that. I've written out my cca request to send tomorrow also my cpr request.
                  Particulars from claim form are
                  The claimant (Cabot) claims payment of the overdue balance due from the defendants under a contract between the defendant and shapely figures.
                  Dated on or about Apr 04 2007 and assigned to the claimant on Jan 13 2012 in the sum of 1581.90
                  Particulars a/c no xxxxxxxxxxxxxxx
                  Date 28/11/14 default balance 1581.90

                    Was it a business account ?

                    Ahh ok ignore me - it's JD Williams so a catalogue account.

                    Do you recall when you last made a payment or spoke with J D Williams ?

                      Yeah its a catalogue hun. I've not made a payment in over 6 years and I've never spoke to them personally. I wrote to then about 6 years ago same thing asking for cca but never got anything back

                        Okay so you opened the account in April 2007 and haven't paid anything since at least December 2008 ? (just double checking)

                        So def get the CCA sent off, I wouldn't worry with the CPR request as they only mention the contract.

                              They also mention the assignment and a default, although if the OP is positive about it being SBd then it's probably not that relevant.
