Its not a phantom, it's our bank who told us that we made it.

We got a reply from cabot this morning saying that they haven't got a copy of the credit agreement and that they would send one within 40 days.

40 days that is for a SAR length of time, they are kidding you! 12 + 2 days allowed they are now in default!

Do you still think that it's worth defending the claim having found out that my husband had made a payment in 2009?

Sorry, it's really quite confusing when you have never been in this situation before!

Hiya, Cabot always say 40 days, they know they are in default, and really although they are they can come up with the agreement any time before the judgment date, so nothing to worry about, you can still put in your defence that they haven't complied and are unable to enforce the debt whilst their default continues.

No, it was a direct debit payment apparently.

After speaking to the bank my husband remembers repeatedly trying to cancel a direct debit that was still taken month after month, and we now know from speaking to the bank that this was for minimum payment for the old vanquis account.

2008 - 2009 accounts in our house were in a complete shambles due to a non paying customer (my husband is a self employed Joiner), all of our income at that time went into the essentials, rent/tax/utilities etc

eek :tinysmile_aha_t:- that's brutal. So the bank has landed you in this by not following your instructions. Not that that helps, sorry, but it makes my blood boil :colbert:

Wonder if any of the banking beagles have a way of getting redress for you? x
