sigh... I think their system is playing up.

Okay you'll need to add the headings to the defence then print to pdf and send as attachment.

Here's the layout - you must sign the statement of truth (a type font is fine)

Ok Amethyst. Thanks I will use that template. I called back again, to clarify that there was no error and I was told no. Just email the defence and it will be processed today.

Please help, I do not understand what this means.
I've read elsewhere that if a defence is received on the due date (14/28 days), a bar is put on the claim to stop judgement by default.

Oh really. Interesting. I will look into it. Thanks for the information. So stressed with everything. My defence had to be in by 31st August 2014. Wonder if that's why a car gas been placed.

                This website is awesome.

                Thanks to everyone. Xxx

                    Hi,

hoping this will put you at ease a little,

you are likely to receive a letter from MCOL, stating that they have received your defence and have sent it to the claimant who will then have up to 28 days to decide whether they wish to continue with the claim

so you should have at least a couple of weeks to relax a little

Re: Cabot Fin Uk & Mortimer Clarke Solicitors;Statute Barred; need help with defence

UPDATE!!! Argh!!! I did not know that the court had sent an email at 3.15pm yesterday (29/08/2014), with the message: SORRY BUT YOUR ATTACHMENT CANNOT BE OPENED, CAN YOU SAVE THE CLAIM FORM AND ATTACH IT IN THE EMAIL.

I only saw the email at 11.45pm ( hubby and child sick). Obviously the court was closed, so could not speak to anyone. I immediately resent the defence, with a covering note by email.

I am so worried. Does this mean my husband has missed the deadline for submission (31/08/2014). I received the standard email acknowledgement from MCOL.

I will telephone Northampton County Court Business Centre on Monday, to clarify my husbands status regarding the claim.

I would not not have been put in this position, if a "bar" had not been placed on the claim, disallowing me to submit it via MCOL .

PLEASE HELP???. HAS ANYONE BEEN IN THIS SITUATION BEFORE?. Just when I thought I could breathe a sigh of relief.

hopefully it should be OK as you had already tried to send it once (you have their email as proof of that) xx

Please can some one please tell me where my husband stands on the submission of his defence as explained in my last post.

Please help. I am worried it will be recorded as received on a different date.

                              thanks in advance.

Re: Cabot Fin Uk & Mortimer Clarke Solicitors;Statute Barred; need help with defence

                                hi wannabe,

first of all stop panicking, you made every effort to send the defence in on the correct date, you also had proof that their was a problem their end, you have also tried again to send it you have a lot of proof you have made every attempt to file this defence.

what, in my opinion, i would also do is print off a copy of the defence and send it recorded delivery to MCOL i would attach a covering letter which simply states:

please find enclosed a written copy of my defence which was sent via e mail on xx date, or something like that.

dont forget to put the case number on the letter do this and post it tomorrow.

that is what i would do, give yourself extra cover, because the copy of the defence will have the date you compiled it written at the top it will help.

                                hope this helps
