  • Cabot Letter re Vanquis

    I was feeling left out having received no random letters from DCA but on return from holiday it has happened.

    I have a whole package of paper from Cabot, including Statement of Account , notice of arrears, payment slip ,
    Date account opened 10/11/2008
    Amount Owing £587.80 accruing interest at 12%

    The Arrears Notice states that it has been sent for compliance with FCA consumer credit sourcebook as I am behind with payments under their agreement.

    There are two slight problems with this
    a/ I have never had a Vanquis credit card
    b/ I have definately not entered into an agreement with Cabot.

    What is the recommended next step?
    Ignore, or write back detailing my disagreement with their paperwork.

    I assume it's a fishing exercise but was wondering as the date is 10/11/2008 if it were the lead up to a bogus money credit claim before the 6 years is up.

    Any advice would be welcome.

    hmm .... maybe write to then stating you do not acknowledge the debt, and advising them that you have never had an account with the companies mentioned?? From what I can make out, the onus is on THEM to prove the debt, not on you to disprove it?!?

    I'm sure there will be more (and more knowledgeable) advise soon

      I'd go with what Kati suggested and would also send a separate formal CCA request for the agreement copy to Cabot.

        I will send a debt not acknowledged letter and see what happens,
        What is the legality of them sending an agreement in arrears letter and adding interest when there has never been an agreement?
        Whilst I have no doubt in this case there is no original Vanquis agreement in my name , can a company suddenly send an arrears letter and a statement showing 6 years interest at £3.70 per month, had the original debt been correct I would still question the amounts Cabot are claiming and they way they are trying to claim it.

          I can virtually guarantee I know whats happened. Vanquis send out "you're already accepted!" credit card application forms, and literally, you are! All you have to do is fill out the form, send it off, and hey presto, you've now got a Vanquis Credit Card with which to spend.

          Only problem is, theres no guarantees who will actually get the application form. If theres a typo or a Postman regularly delivers mail incorrectly to a certain address, someone unscrupulous can fill out the form, pretending to be you, and get a nice shiny credit card in the post.

          I know this, because the missus had this happen to her, the upshot was, I got to flex my "pissed off" letter writing campaign to Vanquis.

          Wasn't without its pitfalls however, they tried to say that all the details were correct and their 'investigation' lead to them convinced that my missus owed the money.

          After some amount of investigation on my part, and general piss taking of their 'investigation', they soon changed their tune.

          The way I tackled it was to get Vanquis to send a comprehensive break down of where the credit card was used, what amounts were spent and in what shops.

          I was then able to categorically prove that my missus wasn't anywhere near these places, but the piece de la resistance was that the person that masqueraded as her, had used the card to pay for a months rent on her house!!!!! An address we no longer lived in, and used the records of the two housing associations to show we didn't live there, and it would be unlikely that my missus would generously pay a months rent for someone else!!

          Be prepared for Vanquis to not give a toss at first, but on the other hand, the 'debt' is statute barred by the sounds of things, and Cabot is fishing for money they ain't entitled to.

            I have been working away, got back to a letter from Cabot to say that they have passed the collection on to their associates Mackenzie Hall , No reponse to any of my requests for proof etc. I eagerly await a letter from Mackenzie Hall

              Hi Mike bit of an odd one really. As you have evidence to prove it was not your partner then they should drop the case. I would write to cabot and explain all of this or phone them up and photocopy the evidence that you have and send it to them also write to Vanquis asking for if they will compensate yourself for the heartache that you have been through.

                Definitely not a partner as I didn't have one,
                I sent Cabot a debt not acknowledged letter and the only reply I have had says they have passed it on ( I Presume sold) to Mackenzie Hall.

                I will wait and see if i get a letter from them then chase it up.

                Even by Cabots dubious information it will be statute barred in 4 weeks

                  If they've passed it on then its either been passed back to Vanquis or another comapany to be honest I'd write to Vanquis and ask for compensattion for the aggravation that it has caused.

                    The letter from Mackenzie Hall has arrived.
                    They are kindly offering me a possible lower settlement figure if I contact them by the 20th.
                    Strangely they arent saying they are assigned the alleged debt but state that their client is Cabot.
                    They also state that if they accept a lower settlement figure that the debt would appear on my credit file as partially settled in order for it to appear as satisfied I must repay the full amount.

                    Where do these idiots get their template letters from?

                    Anyway prove it letter sent.

                              They don't give a settlement figure you have to contact them by phone or email for that and they only say they may have a discount and only if I reply by the 20th.
                              I just find Mackenzie Hall acting on behalf of Cabot to be ironic.
