    amethyst this morning I received a letter from Mortimer Clarke, strange considering I got one yesterday from cabot, here is a copy. I don't understand it can you help.

    we have received your defence and letter dated 05/07/2014

    We are taking are clients instructions on the issues which you raise. In the meantime, we ask that you provide clarification regarding to whom the
    copy letters provided with your defence were addressed to, as we are unable to confirm receipt of these letters.
    please respond within the next 7 days. we look forward to hearing from you.


    no signature just Mortimer Clarke....

      Is that a letter or an email ? Which letters are they referring to ? What defence are they referring to ?

      What did you put in when you entered the acknowledgement of service?

              I had this the other day from the court,
              I acknowledge receipt of your defence. a copy is being served on the claimant (or the claimants solicitor)
              the claimant may contact you direct to attempt to resolve any dispute. if the dispute cannot be resolved informally,
              the claimant will inform the court that he wishes to proceed. the court will then inform you of what will happen.
              where he wishes to proceed, the claimant must contact the court within 28 days after receiving a copy of your defence. after thar period
              has elapsed the claim will be stayed. the only action the claimant can then take will be to apply to a judge for an order lifting the stay.

                Thank you for your letter, although I am slightly confused by the content. I haven't entered a defence in the claim as I am still awaiting documentation from yourselves and your client. Please could you check your records and confirm to me what you require.

                    no I didn't write anything on the claim form I enclosed copys of both letters to the court of what I sent to cabot and Mortimer, just so the court hav copies too.

                      mmmm maybe give Northampton court a call then, and check they haven't entered your acknowledgement of service as a defence.

                            arrrrrrgggggggghhhhhhhhhhhhhhh. ive rang the court and they think its been filed wrongly, the lady I spoke to said shes gonna speak to her line manager now and email me asap. she said it would b best to start getting my defence ready now, to fill out the defence form based on the info given on the particulers of claim but to add I,m waiting for documnts from cabot and Mortimer...................I don't know what to do now, sat here crying as it feels like its all coming crashing down..... I was so hopeful before now I just feel lost and unsure about what I,m doing . its all above my head feel like giving up now

                              Nooo don't worry, it's fixable we were going to do a defence anyway. Court are aware they have filed it wrong so it's fine. We'll fix it okay xxxxx

                                Okay put together a pile of all the letters you have sent and received since issue of the claim, and write me a brief list with dates.

                                Will help you get a defence written to send in tomorrow. You'll need to send two copies in so once we've got it all together you'll need to get it all photocopied, then sent in an A4 envelope to court by recorded delivery.

                                Cabot and Mortimer have just been obstructive and the court have been crap so don't worry, you've done nothing wrong and everything is still on track fine.

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
