    yes i have sent the 2 letters 1 containing the postal order and i sent them special delivery.

      so it says 5 days from the date stated 20th June, so the 28 days is up 22nd of July how long should I leave until I get back to the court sorry I really don't know anything about this or how to handle it, again Thank You so much.

        If you don't hear back and you are getting towards a week from the last day then you need to take the initiative and contact them to chase up. More likely, they will contact you quite quickly to say they don't have the documentation and have had to ask for this from the original lender. In that case you can request an extension to the 28 days for their compliance and assuming they agree you then notify the court.

            My guess is with this one is that it flagged up that the Limitation period was about to expire (assignment was October 2008) and so they have filed the claim before that period runs out. We still don't know when you last paid though and they could still be bluffing. It doesn't matter to DCAs if they lose a lot of claims because they are statute barred or because they can't produce the required documentation. That's because they only pay about 5% of the face value to buy an account once its been written off, so they only have to win the odd one to more than pay for the losses on a number of others. Basically they rely on people not fighting back and not knowing the law, which is why forums like this exist to help.

            It will really help you if you spend time reading around other DCA claim threads to see what the different processes are and how they often work out. Here is a current one of mine that is unfolding much as I expect yours to. In my case I thought it was statute barred, but when I checked I did make a few small payments to defuse a threat about 5 years ago. It's easy to forget.

              We confirm our client is willing to agree to an extension of 28 days, for you to file
              your defence. Pursuant to CPR 15.5(2) please notify the court in writing of the
              agreement.

                Well name, address and Vanquis should be enough being as they have bough a court claim against you for it. Did you include your address in the letter ?

                  Regarding their agreement to an extension, you need to email the court to let them know both parties have agreed to an extension of 28 days under CPR 15.5 ccbcdefendants@hmcts.gsi.gov.uk

                    Yes i did include full name, address and postcode on the court doc there was no account number only my name and address and i will email the court today to let them know.

                      Maybe reply and give them the claim number and solicitors name that they are using to bring the court claim against you, so they 'may make further enquiries'.

                            I'm sorry really out of my depth here, i did the acknowledgement on the court site and asked for 28 days which is up on the 22nd July is this another 28 days.

                              YEs, it's 28 days added to the original defence filing date - so extension will be until Tuesday, August 19, 2014
